Petitioner, RAYMOND LIGGIO, being duly sworn, makes this Affidavit in support of his motion to renew and states as follows: 1. Petitioner received the Court's decision dated December 11, 2023, wherein the Court stated that as follows: Denied without prejudice. Petitioner fails to indicate whether Vincenzo Liggio has any other children that should be noticed on this petition. Additionally, petitioner is referred to Civil Rights Sec. 6 regarding changing his name. [Exhibit 1] 2. Regarding the first part of the court's decision, I swear under oath that my father had three children, Linda Liggio (Marino), Vincent, Jr (named after our father), and me. To further confirm same, I submit Fox Funeral Home's Memorial page for my brother, 2019.1 Vincent Liggio, born 1932, and passed away in In said tribute, my brother Vincent's daughter acknowledges that Vincent had two siblings: the middle - his a few years older and his My Dad was child sister, Linda, brother, Raymond, ten years younger. [Exhibit 2] 4. Further within the tribute, under the section titled, "Memories of Vinny", I also added a section about our family: My brother Vinnie left us yesterday just a year after our sister Linda died. Vinnie was 10 years older than I and Linda was 13 years older. [Id.] 5. This information corroborates the ages on the 1950 census report and further confirms the fact that there were three siblings and two are no longer living. 6. In addition, I submit proof that Linda is no longer living. A copy of Linda's New York State death certificate is attached at Exhibit 3. Said certificate states that Linda Marino passed away on September 3, 2018, and she was the daughter of Vincent Liggio and Jean Malatino. [Exhibit 3] Marino was Linda's married surname. [Exhibit 4] 7. I submit further proof that my brother, Vincent, is no longer living. A copy of Vincent's New York City death certificate is attached at Exhibit 5. Said certificate states that Vincent Liggio (also known as Vincent Nicholas Liggio) passed away on September 20, 2109, and he was the son of Vincent J. Liggio and Jean Malatino. [Exhibit 5] 8. I am the sole surviving child of Vincent Liggio who was born in the United States. 9. I respectfully request this Court grant the motion to renew and that it reconsider its decision given the new evidence that I am the sole surviving child of Vincent Liggio. I further respectfully request this Court enter a one and the same declaration with regard to my father's identity and my identity.
