YASMIN VANESSA GONZALEZ RIVERA being duly sworn deposes and says:
1. I am a Respondent and I make this Affidavit under the penalties of perjury.
2. On December 18, 2022, at approximately 5:43 a.m., I was a involved in a
46th 161st
motor vehicle collision which occurred on Avenue, near its intersection with
Street, in Queens, New York.
3. At the above-referenced time and location, I was operating my 2004 Honda
46th
bearing the New York State registration number KUY6361 eastbound on Avenue when
it was struck in the rear by a vehicle which subsequently fled the scene following the
collision and prior to the arrival of the police.
4. Prior to its leaving the scene, I attempted to take note of and write down the
license plate number which, at the time, I believed to be EMK5324 which I understand to
be registered to a 2008 Honda owned by Proposed Additional Respondent DANIEL CHOU.
5. Unfortunately, at the moment of the collision, I was so shaken up that, by the
time I realized that the other vehicle was fleeing the scene, I cannot be certain that the
license plate that I wrote down is correct.

6. As a result of the collision, I sustained serious personal injuries including, but
not limited to, herniated discs in my neck and back, a tear in my right shoulder and injuries
to my left shoulder and left knee, for which I was required to undergo extensive physical
therapy and treatment, the effects of which are permanent in nature. In addition, and due
to my injuries, I underwent surgery to my right shoulder on February 8, 2023 as well as
injections to help alleviate the pain.
7. Also present in my vehicle was the Respondent, ANABEL GARCIA
JADADIC, who complained to me of injuries at the scene as well.
8 My attorneys have informed me that LIBERTY MUTUA; lESUVANCE
COMPANY, the insurance company for my vehicle, has brought a Petition seeking to Stay
the Uninsured Motorist Arbitration which I have sought.
9. I have been further informed that GEICO INSURANCE COMPANY, the
insurance company for the vehicle registered to the plate which I copied down following the
accident, has denied my claim based on the non-involvement of their insured.
10. As stated above, I am uncertain if the plate I copied is in fact the correct plate
number. And based on that fact and the denial from GEICO INSURANCE COMPANY, I
respectfully ask this Court that I be permitted to proceed with my Uninsured Motorist
Arbitration.
WHEREFORE, I respectfully request that the Court issue an Order denying the
Petition to Stay Arbitration.

1. Soy un Demandado y hago esta Declaración Jurada bajo pena de perjurio.
2. El 18 de diciembre de 2022, aproximadamente a las 5:43 a. m., estuve
involucrado en una colisión automovilística que ocurrió en la Avenida 46, cerca de su
intersección con la Calle 161, en Q ueens, Nueva York.
3. En el momento y lugar mencionados anteriormente, estaba operando mi Honda
2004 con el número de registro del estado de Nueva York KUY6361 en dirección este en
46th Avenue cuando fue golpeado en la parte trasera por un vehículo que posteriormente
huyó de la escena después de la colisión y antes de la llegada de la policía.
4. Antes de que abandonara la escena, intenté tomar nota y anotar el número de
placa que, en ese momento, creía que era EMK5324 y que entiendo que estaba registrado
a nombre de un Honda 2008 propiedad del demandado adicional propuesto DANIEL
CHOU.
5. Desafortunadamente, en el momento de la colisión, estaba tan conmocionado
que, cuando me di cuenta de que el otro vehículo huía del lugar, no puedo estar seguro
de que la placa que anoté sea correcta.

6. Como resultado de la colisión, sufrí lesiones personales graves que incluyen,
entre otras, hernias de disco en el cuello y la espalda, un desgarro en el hombro derecho
y lesiones en el hombro izquierdo y la rodilla izquierda, por las cuales fui requerido.

JADADIC, quien también se quejó de lesiones en el lugar.
8. Mis abog dos rne han inforrnado que ;IBERTY MlJTUAL, INSURANCE
COMPANY, la compañía de seguros de mi vehículo, ha presentado una Petición para
suspender el arbitraje para conductores sin seguro que he solicitado.
9. Se me ha informado además que GEICO INSURANCE COMPANY, la compañía
de seguros del vehículo registrado en la placa que copié después del accidente, ha
denegado mi reclamo basándose en la no participación de su asegurado.
10. Como se indicó anteriormente, no estoy seguro de si la placa que copié es en
realidad el número de placa correcto. Y con base en ese hecho y la denegación de GEICO
INSURANCE COMPANY, solicito respetuosamente a este Tribunal que se me permita
proceder con mi Arbitraje para conductores sin seguro.
