at 60 Centre Street, New Y ork, NY at 9:30 in the forenoon of that day or as soon thereafter as
counsel can be heard for an Order:
(a) Pursuantto CPLR § 2221(d), granting Third-Party Defendant LUZ DEL ALBA SANTOS
leave to reargue the Court's prior Decision/Order, dated April 27, 2023, denying Third-
Party Defendant’s motion seeking summary judgment on liability;
(b) Upon reargument, vacating the Court’s prior
A pril 27, 2023 Decision/Order and, pursuant
to CPLR § 3212, issuing an Order dismissing the Third-Party Complaint, all cross

PLEASE ALSO TAKE NOTICE, that all answering papers, if any, must be served at
least seven (7) days prior to the return date of this motion pursuant to CPLR 2214(b).
