Participation in early mediation is mandatory absent a showing that a party would be subjected to unreasonable hardship or burden by participation in the mediation. PMP conferences take place IN PERSON before the Administrative Judge, Honorable Adam Silvera or his designee. For the specific date, time and location of the conference in your case, please refer to WebCivil Supreme - Case Search, eTrack, SCROLL or your court service provider. Please confer with the other counsel on the case and jointly contact the ADR Coordinator with documentation in advance of the PMP conference if: o The matter is stayed due to bankruptcy filing or court order o There is a related matter not on the scheduled calendar o The case has been consolidated with or into another case not on the scheduled calendar o This matter has been settled, discontinued, or dismissed o Parties have stipulated to participate in mandatory early mediation and have completed the ADR Initiation Form A party seeking an exemption from early mediation based on a showing of unreasonable hardship or burden must make an application for such at the PMP conference. Criteria for eligibility ▪ The case is e-filed ▪ All parties are represented by counsel ▪ Parties are not in default ▪ An RJI was filed ▪ The RJI has designated the nature of the case as: o Contract o Business Entity o Insurance o UCC o Other Commercial ▪ The case is assigned to any Justice of the court who has not been appointed to serve in the Commercial Division ▪ A preliminary conference was requested The Purpose of the Conference ▪ Confirm that the case is appropriate for early mediation. Participation in early mediation is mandatory absent a showing that a party would be subjected to unreasonable hardship or burden by participation in the mediation. ▪ Order limited, expedited pre-mediation discovery. Pre-mediation discovery is limited to discovery that is necessary for a meaningful mediation. NO. 41 RECEIVED NYSCEF: 12/08/2023 ▪ Counsel shall discuss mandatory early mediation with their clients in advance of the PMP conference ▪ Counsel shall discuss with one another in advance of the conference the provision and exchange of discovery, if necessary, that is tailored to the mandatory early mediation ▪ Participation in early mediation is mandatory absent a showing that a party would be subjected to unreasonable hardship or burden by participation in the mediation ▪ A party seeking a PMP exemption must make an application for such at the PMP conference ▪ Counsel may stipulate or be required to draft a proposed PC order at the PMP conference for submission to the assigned justice ▪ A compliance conference before the assigned justice shall ideally take place after the conclusion of mediation unless the case is resolved in mediation ▪ Completion of the ADR Initiation Form by counsel for all parties is required for participation in the Court’s ADR program ▪ All court proceedings other than the ADR proceeding shall be conducted by the justice assigned to the case NYSCEF Filings All ADR documents filed on NYSCEF must be filed as an ADR document type.
