The Plaintiff, ACNB Bank, is a Pennsylvania financial institution organized and existing under the laws of the Commonwealth of Pennsylvania, having a mailing address of P. 0. On•or about November l, 2013, in consideration of a home equity line of credit, made by Plaintiff to Defendant, which funds were received, the said Defendant, as Borrower, executed and delivered to the Plaintiff, as Lender, a Home Equity Line of Credit Agreement and Disclosure dated November 1, 2013, (the "Agreement"), with a credit line of$120,000.00 (the "Principal"), and requiring the payment of interest on the credit line initially at the rate of 3.250% per annum for the first 12 months (the "Interest"). After the first 12 months, the Periodic Rate and corresponding Annual Percentage Rate on the Agreement is based on an independent index which is the highest base rate on corporate loans at large U.S. money center commercial banks that the Wall Street Journal publishes as the Prime Rate. The interest rate is not less than 3.740% per annum. The draw period is 120 months, beginning November 6, 2013, followed by a repayment period of 180 months. The Agreement has a maturity date of November 30, 2038. A true and correct copy of the Agreement is attached hereto as Exhibit "A" and incorporated herein. 5. The Agreement obligates the Defendant to pay to Plaintiff a monthly Minimum Payment, equal to the amount of accrued Finance Charges ("First Payment Stream"). The First Payment Stream will last for the first 120 Months. This Minimum Payment is the Regular Payment, plus any amount past due and all other charges. An increase in the Annual•Percentage Rate may increase the amount of the Regular Payment. The payment to Plaintiff by Defendant of the Payments due under the Agreement is secured by an Open - End Mortgage and Security Agreement on the Property dated November 1, 2013, (the "Mortgage"), executed, conveyed and delivered by Defendant as Grantor, to Plaintiff as Lender. A true and correct copy of the Mortgage is attached hereto as Exhibit "B" and incorporated herein. 7. The Mortgage was duly recorded in the Office of the Recorder of Deeds in and for York County, Pennsylvania, on November 21, 2013 in Record Book 2259, Page 8187. 8. The Defendant has failed to make Payments of $683.09 for January 30, 2023; $761.51 for February 28 2023; $756.62 for March 30, 2023; $893.66 for April 30, 2023; and $837.06 for May 30, 2023. The total of these Payments is $3,931.94. The Defendant owes late fees in the amount of $180.00. The Defendant also owes 2022 real estate taxes in the amount of $9,946.00. The taxes will continue to incur penalties. These items all constitute default under the terms of the Mortgage. 9. The Property subject to the lien of the Mortgage is described as follows: A.
