COMES NOW, Defendant, Idemili Foundation, Inc. Dallas/Ft Worth’s and files this
Motion to Continue the Trial Setting and would show unto the Court as follows:
I. RELIEF REQUESTED
1 This case was filed on July 16, 2021.
2. The current trial in this case is set for January 23, 2024 at 9:00 a.m.
3 Granting of this emergency motion will allow Mr. Okey Akpom to return from
Nigeria after the cancellation of his flight in Frankfurt Germany to the US as a result of bad
weather.
4. Kenneth Onyenah, counsel for ICAN and the individual Defendants including
Nwokocha, agree to continue this case. Counsel for Plaintiff, Donald M. Kaiser Jr., at the
EMERGENCY MOTION TO CONTINUE TRIAL SETTING 1
time of filing of this motion has not indicated his agreement or disagreement to this
emergency motion.
5 This request is not for the purpose of delay, but so that justice may be done.
6 Defendant, Idemili Foundation, Inc. Dallas/Ft Worth has not previously asked for a
continuance.
