Respondent.
Petitioner above-named petitions the Court pursuant to the provisions of Minnesota
Statutes Chapter 278 and respectfully pleads certain claims, defenses and objections together with
allegations in support thereof, as follows:
I.
That at all times material Petitioner has had an estate, right, title or interest in the parcel(s)
of real property located in the City of St. Paul, County of Ramsey, and State of Minnesota (the
“property”), described on the attached Exhibit A parcel listing and County property record
information.
II.
That said property, including the land and the improvements located thereon, was valued
and assessed for general real property taxes payable in the year 2024 at an estimated market value
indicated on the assessor’s records by a method of valuation employed by the assessor responsible
for making such valuations.

III.
That said valuation and assessment were and are in excess of the real and actual market
value of said property, and said property is therefore not being taxed equally or fairly with real
property of the same class in the same locality and comparable localities in said City, County and
in the State of Minnesota.
IV.
That the actual market value of property as of the assessment date pertinent herein based
upon comparison with property of the same class and in comparable localities, was substantially
less than the estimated market value placed upon the property by the assessor.
V.
That the aforesaid market value and resultant assessed value as determined by the assessor
for the said property are greater in amount than can lawfully or constitutionally be established or
imposed upon said property; that said values were determined and imposed in an arbitrary and
unreasonable manner and are excessive, non-uniform, unfair, discriminatory, illegal and invalid;
and that the aforesaid tax imposed on the said property by reference to the aforesaid values is
illegal and invalid, being contrary to and in violation of Chapters 272-276 and 278 of Minnesota
Statutes, Article I, Section 7 and Article X, Section 1 of the Constitution of Minnesota, and the
Fourteenth Amendment of the Constitution of the United States.
VI.
That no proceeding of any kind for the correction of the assessment against the aforesaid
real property for the years in question is pending in any court.

WHEREFORE, petitioner, Brock St Paul Opportunity Business I LLC, prays that the Court
determine the validity of petitioner’s claims, defenses and objections and make its Order as
follows:
1. Determining that the estimated market value, resulting assessed value and general
taxes on said real property should be reduced in accordance with the evidence, and
the laws of the State of Minnesota and the United States;
2. Determining the proper classification for said property;
3. Determining that petitioner recover interest at the legal rate on that amount of the
general real estate taxes paid in excess of the Court determination herein;
4. Determining that petitioner recover its legal fees, costs and disbursements; and
5. Granting such other and further relief as the Court may determine just and
equitable.
The undersigned party by its attorney hereby acknowledges that costs, disbursements and
reasonable attorney and witness fees may be awarded pursuant to Minn. Stat. § 549.211, to the
party against whom the allegations in this pleading are asserted.
