Dear Honorable Judge Tillery:
On January 12, 2024, I submitted a letter on behalf of Plaintiff B&R Wiley Family, L.P.
d/b/a Servpro Mesquite, Kaufman County, and Cedar Creek; Defendant Brandon J. Wiley;
Defendant Regina L. Wiley; Defendant Jennifer Evartt; and Defendant Edward Evartt (the
“Servpro Parties”) informing the Court that a ruling on the Servpro Partis’ Motion for Partial
Summary Judgment Based on the Limitation of Liability Provision in Servpro’s Contract with
Plaintiffs (“Motion”) will aid the parties in preparing for trial and might allow the parties to resolve
this matter. In response, Plaintiffs submitted a “responsive” letter on January 12 wherein Plaintiffs
inappropriately raised legal arguments related to the Motion.
The Motion has been fully briefed, including limited post-hearing letter briefing at the
request of the Court. The Servpro Parties’ January 12, 2024 letter did not discuss the Servpro
Parties’ position or contain legal arguments whatsoever. Plaintiffs’ responsive letter containing its
legal position and arguments is improper and should not be considered by the Court. Neither the
Texas Rules of Civil Procedure nor any applicable Local Rules allows a party to submit legal
arguments in this fashion, well after the hearing and after all briefing was submitted. Moreover,
Plaintiffs’ tactics undermine the generally accepted legal principle that movants to a motion (in
this case, the Servpro Parties) get the final word as they hold the burden of proof.
For these reasons, the Servpro Parties respectfully request the Court to ignore any
arguments raised by the Plaintiffs in their January 12, 2024 letter and issue any ruling related to

the Motion based on the briefing of the parties before and immediately after the hearing along with
oral argument.
Of course, please do not hesitate to reach out if the Court has any questions or wishes to
discuss this matter further. This letter is being served upon all counsel of record via the e-file
