Heritage House Clocks, Inc. et al; Cause No. DC-2007433; pending in the 134th Judicial District; Dallas County, Texas Dear Honorable Judge Tillery: I am writing to you as local counsel for Defendant and Counter-Plaintiff B&R Wiley Family, L.P. d/b/a Servpro Mesquite, Kaufman County, and Cedar Creek; Defendant Brandon J. Wiley; Defendant Regina L. Wiley; Defendant Jennifer Evartt; and Defendant Edward Evartt (the “Servpro Parties”). This case is currently set for trial on February 5, 2024, with pretrial conference set for February 2, 2024. The Servpro Parties filed a Motion for Partial Summary Judgment Based on the Limitation of Liability Provision in Servpro’s Contract with Plaintiffs on February 23, 2022. The Court entertained oral argument related to this Motion on April 2, 2022, and shortly thereafter the parties submitted limited letter briefing to the Court. As the parties prepare for trial and begin to craft the jury charge, the Servpro Defendants respectfully submit that a ruling on their Motion for Partial Summary Judgment – which would limit Plaintiffs’ damages – will greatly impact the parties’ trial preparation and the form of the jury charge. The Servpro Defendants also believe that a ruling on this motion may provide the impetus to allow the parties to attempt to resolve this matter prior to trial. For these reasons, the Servpro Defendants respectfully request that the Court consider ruling on the Motion for Partial Summary Judgment in anticipation of the upcoming pretrial conference so the triable issues are defined and the parties have the information needed to attempt to determine whether resolution without trial might be possible.
