On 11/7/2023 , 2023, the Court considered Plaintiffs’ Objections to the
evidence and/or exhibits attached to Defendant Atmos Energy Corporation’s Motion for Summary
Judgment. After considering the Motion, the Response, the Objections, the Reply, evidence, and
arguments of counsel, the Court finds the following:
Plaintiffs’ objections to Defendant’s Exhibit 2, the declaration of Graham Landell Perry,
are SUSTAINED OVERRULED.
Plaintiffs’ objections to Defendant’s Exhibit 2-A, the Master Services Agreement between
Atmos Energy Corporation and FESCO, are SUSTAINE I OVERRULED.
Plaintiffs’ objections to Defendant’s Exhibit 2-B, a highlighted version of Exhibit 2-A, are
SUSTAINED VERRULED.
Plaintiffs’ objections to Defendant’s Exhibit 2-C, a copy of the alleged task request that
FESCO was working pursuant to on June 28, 2021 and allegedly applied to the work taking place
when the incident giving rise to this action occurred, are SUSTAINE I OVERRULED.
Plaintiffs’ objections to Defendant’s Exhibit 2-D, a copy of Atmos Energy Corporation’s
certificate of insurance for FESCO as of June 28, 2021, are SUSTAINED VERRULEDQ
Plaintiffs’ objections to Defendant’s Exhibit 2-E, a highlighted version of Exhibit 2-D, are
SUSTAINED VERRULED.
Plaintiffs’ objections to Defendant’s Exhibit 4, the declaration of Michael D. Flores, who
attempts to authenticate a document purporting to be Mr. Tarver’s acceptance of worker’s
compensation insurance coverage, are SUSTAINED/ OVERRULED.
Further, the Court considered Atmos Energy Corporation’s Motion for Summary
Judgment. After considering the Motion, the Response, Reply, if any, evidence, and arguments of
counsel, the Court finds that the Motion should be DENIED.
It is THEREFORE ORDERED, ADIUDGED, AND DECREED that Atmos Energy
Corporation’s Motion for Summary ludgment is DENIED.
