BERNARD ISAAC being duly swom deposes and says:
1. I am the Plaintiff and I make this Petition under the penalty of perjury.
2. On April 27, 2023 at approximately 1:23 p.m., I was involved in a rear-end
motor vehicle collision which occurred at the intersection of Plymouth Drive and County
Line Road, in Suffolk County, New York.
3. Atthe above-referenced time and location, I was stopped for a clearly posted
"Stop"
sign in my 2006 Toyota bearing the New York State registration number GCA5818
when I was struck in the rear by a 2016 Kenworth bearing the New York State registration
number AX3397 which I later learned was owned by Defendant TOWN OF BABYLON and
operated by Defendant JOSEPH JOHN CONTl.

4. At the moment of the collision, I was stopped for a clearly posted sign
and my vehicle's brake lights were properly functioning and illuminated.
5. On the date and at the time of the collision, the weather was clear, the roads
were dry and the visibility was excellent.
6. As a result of the collision, I sustained serious personal injuries including, but
not limited to, hernisted discs in my neck and lower back as well as tears in my left
shoulder and left knee, the effects of which are permanent in nature and for which I
underwent an intensive course of physical therapy.

7. My attorneys have informed me that this Affidavit is being submitted in
connection with my application which seeks Leave of the Court to file and serve a Late
Notice of Claim pursuant to General Municipal Law §50-e which I understand had to be
filed and served on or before July 26, 2023.
8. As stated above, my accident occurred on April 27, 2023. And while I
retained my attorneys, Goldin & Rivin, PLLC., on May 7, 2023, it is my understanding that
the Police Accident Report which was prepared in connection with my accident was not
available until late September, 2023 which, for the first time, is when my attorneys were
made aware of the fact that the offending vehicle was owned by the Defendant, TOWN OF
.. . . . .. . BABYLON and after the July 26, 2023 deadline to file a Eotice of Cjaim.
9. I understand that we are still within the one year and ninety day Statute of
Limitations to file a lawsuit and that there has been no prejudice to TOWN OF BABYLON
for this short delay in filing a Notice of Claim.
10. I pray that this Court not penalize me for this unfortunate set of circumstances
which I do not believe was in any way the fault of my attorneys. As stated above, this
accident was not my fault and I have sustained serious personal injuries and respectfully
request that I be permitted to have my day in Court.
WHEREFORE, I respectfully request that the Court grant the application which has
sought Leave to File and Serve a Late Notice of Claim pursuant to General Municipal Law
§50-e.

1. I am not a party to this action.
2. I am over the age of 18 years.
3. I reside in the State of New York.
4. I am a citizen of the United States, with my country of
origin being Haiti.
5. I am not related to any of the parties in any way.
6. I am employed as a clerk, secretary, paralegal and
translator in the office of Goldin & Rivin, PLLC.
7. I am proficient and fluent in both the English language
and the Creole language. I was raised in a home where Creole was
spoken on a regular basis by native Creole speakers.
8. I am a qualified translator and competent to act as an
interpreter and translator from English to Creole and from Creole
to English, and, as part of my professional responsibilities, I
regularly translate for clients from English to Creole and from
Creole to English.
9. My qualifications as an interpreter and translator
include the fact that I have completed English language courses and
that I routinely and regularly translate documents and language for
Creole speaking individuals from English to Creole and from Creole
to English.
