20 "Plaintiff', alleges:
21 GENERAL ALLEGATIONS
22 1. Plaintiff is a Delaware Statutory Business Trust.
23 2. Plaintiff is informed and believes and thereon alleges that at all times herein mentioned,
24 Defendant Sweet Beast Desserts, Inc., is a California Corporation doing business in the County of Kern,
25 State of California.
26 3. Plaintiff is informed and believes and thereon alleges that at all times herein mentioned,
27 Defendant Melinda Castro (hereinafter "Defendant" ) is an individual residing in the County of Kern,
28 State of California.

4. The true names and capacities, whether individual, corporate, associate, or otherwise, of
Defendants named herein as Does 1 through 10, inclusive, are unknown to Plaintiff at this time;
Plaintiff will seek leave of court to amend this complaint when the same becomes fully ascertained.
5. Plaintiff is informed and thereon alleges that each of the fictitiously named Defendants
and thereon alleges that each of the fictitiously named Defendants is responsible in some manner for the
occurrences herein, has possession of any Vehicle sought to be recovered herein, and the amounts due
to Plaintiff as alleged herein are due and owing form such Defendants, and each of them.
FIRST CAUSE OF ACTION
10 (Breach of Contract)
6. Plaintiff hereby realleges and incorporates paragraphs 1 through 5, inclusive, of the
12 general allegations as though fully set forth herein
13 7. On or about December 11, 2021, Defendant Sweet Beast Desserts, Inc., and Defendant
14 Melinda Castro (hereinafter collectively "Defendants" ) entered into a written Lease Agreement with
15 Porsche Bakersfield whereby Porsche Bakersfield leased to Defendants, and Defendants received
16 possession of a motor vehicle described as a 2022 Audi Q7, vehicle identification number
17 WA I LXBF71ND004321 (hereinatier "Vehicle" ). A true and correct copy of Agreement is attached
18 hereto and marked as Exhibit "1" and incorporated herein by reference. As part of Agreement Porsche
19 Bakersfield assigned all of its rights, title, and interest under Agreement to Plaintiff. See Exhibit l.
20 8. Pursuant to the Agreement, Defendants took possession of the Vehicle. Plaintiff is the
21 registered owner and lienholder of record on the Vehicle with such ownership being registered with the
22 California Department of Motor Vehicles. A true and correct copy of the Certificate of Title for the
23 Vehicle is attached hereto as Exhibit "2" and incorporated herein by reference.
24 9. Pursuant to the terms and conditions of the Agreement, Defendants agreed to pay
25 Plaintiff $4,000.00 at lease signing followed by forty-one (41) consecutive monthly installment
26 payments in the amount of $ 1,699.93 due on the 10'" of each month.

COMPLAINT
1 10. Plaintiff has fully performed all promises, covenants and conditions owed to Defendant
2 under the Agreement. However, from and since February 10, 2023, Defendants failed to make the
3 required monthly installments as they became due pursuant to the terms thereof.
4 11. Thereover, Plaintiff demanded that Defendants return the Vehicle to Plaintiff.
5 Defendant refused and failed to turnover possession of the Vehicle to Plaintiff.
6 12. The current estimated Fair Market Wholesale value of the Vehicle is $ 60,932.00 and the
7 estimated Fair Market Retail value of the Vehicle is $ 72,298.00 according to present market values and
8 "J.D. Power" Official Used Car Guide. A true and correct copy of the relevant "J.D. Power" authority is
9 attached hereto and marked as "Exhibit 3" and is incorporated herein by reference.
10 13. As a proximate cause of the default of Defendants in performing under the Agreement by
11 refusing to return the Vehicle, Plaintiff was entitled to, and did accelerate, the total amount due under
12 the Agreement. The amount presently due and owing froin said Defendants to Plaintiff is $ 81,483.60,
13 plus attorney's fees and costs.
14 14. Pursuant to the terms and conditions of the Agreement, Plaintiff is entitled to recover all
15 actual costs and expenses of enforcement of the Agreement, including reasonable attorneys'ees
16 incurred in the event of the default thereunder. Plaintiff has retained legal counsel to enforce the terms
17 and conditions of the Agreement and, as such, is entitled to an award of such fees, costs and interest.

19 SECOND CAUSE OF ACTION
20 (Claim and Delivery)
21 15. Plaintiff hereby realleges and incorporates paragraphs 1 through 14, inclusive, of the
22 above allegations as though fully set forth herein.
23 16. Pursuant to the provisions of the Agreement, and in the event of default such as exists in
24 this case, Plaintiff is entitled to retake possession of the Vehicle from Defendants, and herein makes
25 claim for possession.

WHEREFORE, Plaintiff, VW Credit Leasing LTD, prays for judgment against defendants, and
each of them, as follows:
1. For damages in the sum of $ 81,483.60;
2. For possession of the Vehicle described herein or its equivalent value;
3. For reasonable attorney's fees;
4. For costs of suit incurred herein; and
5. For such other and further relief as the court may deem just and proper.

Plaintiff is a Delaware Statutory Business Trust. 23 2. Plaintiff is informed and believes and thereon alleges that at all times herein mentioned, 24 Defendant Sweet Beast Desserts, Inc., is a California Corporation doing business in the County of Kern, 25 State of California. 26 3. Plaintiff is informed and believes and thereon alleges that at all times herein mentioned, 27 Defendant Melinda Castro (hereinafter "Defendant" ) is an individual residing in the County of Kern, 28 State of California. 1 COMPLAINT 4. The true names and capacities, whether individual, corporate, associate, or otherwise, of Defendants named herein as Does 1 through 10, inclusive, are unknown to Plaintiff at this time; Plaintiff will seek leave of court to amend this complaint when the same becomes fully ascertained. 5. Plaintiff is informed and thereon alleges that each of the fictitiously named Defendants and thereon alleges that each of the fictitiously named Defendants is responsible in some manner for the occurrences herein, has possession of any Vehicle sought to be recovered herein, and the amounts due to Plaintiff as alleged herein are due and owing form such Defendants, and each of them. FIRST CAUSE OF ACTION 10 (Breach of Contract) 6. Plaintiff hereby realleges and incorporates paragraphs 1 through 5, inclusive, of the 12 general allegations as though fully set forth herein 13 7. On or about December 11, 2021, Defendant Sweet Beast Desserts, Inc., and Defendant 14 Melinda Castro (hereinafter collectively "Defendants" ) entered into a written Lease Agreement with 15 Porsche Bakersfield whereby Porsche Bakersfield leased to Defendants, and Defendants received 16 possession of a motor vehicle described as a 2022 Audi Q7, vehicle identification number 17 WA I LXBF71ND004321 (hereinatier "Vehicle" ). A true and correct copy of Agreement is attached 18 hereto and marked as Exhibit "1" and incorporated herein by reference. As part of Agreement Porsche 19 Bakersfield assigned all of its rights, title, and interest under Agreement to Plaintiff. See Exhibit l. 20 8. Pursuant to the Agreement, Defendants took possession of the Vehicle. Plaintiff is the 21 registered owner and lienholder of record on the Vehicle with such ownership being registered with the 22 California Department of Motor Vehicles. A true and correct copy of the Certificate of Title for the 23 Vehicle is attached hereto as Exhibit "2" and incorporated herein by reference. 24 9. Pursuant to the terms and conditions of the Agreement, Defendants agreed to pay 25 Plaintiff $4,000.00 at lease signing followed by forty-one (41) consecutive monthly installment 26 payments in the amount of $ 1,699.93 due on the 10'" of each month. 27 28 2 COMPLAINT 1 10. Plaintiff has fully performed all promises, covenants and conditions owed to Defendant 2 under the Agreement. However, from and since February 10, 2023, Defendants failed to make the 3 required monthly installments as they became due pursuant to the terms thereof. 4 11. Thereover, Plaintiff demanded that Defendants return the Vehicle to Plaintiff. 5 Defendant refused and failed to turnover possession of the Vehicle to Plaintiff. 6 12. The current estimated Fair Market Wholesale value of the Vehicle is $ 60,932.00 and the 7 estimated Fair Market Retail value of the Vehicle is $ 72,298.00 according to present market values and 8 "J.D. Power" Official Used Car Guide. A true and correct copy of the relevant "J.D. Power" authority is 9 attached hereto and marked as "Exhibit 3" and is incorporated herein by reference. 10 13. As a proximate cause of the default of Defendants in performing under the Agreement by 11 refusing to return the Vehicle, Plaintiff was entitled to, and did accelerate, the total amount due under 12 the Agreement. The amount presently due and owing froin said Defendants to Plaintiff is $ 81,483.60, 13 plus attorney's fees and costs. 14 14. Pursuant to the terms and conditions of the Agreement, Plaintiff is entitled to recover all 15 actual costs and expenses of enforcement of the Agreement, including reasonable attorneys'ees 16 incurred in the event of the default thereunder. Plaintiff has retained legal counsel to enforce the terms 17 and conditions of the Agreement and, as such, is entitled to an award of such fees, costs and interest. 18 19 SECOND CAUSE OF ACTION 20 (Claim and Delivery) 21 15. Plaintiff hereby realleges and incorporates paragraphs 1 through 14, inclusive, of the 22 above allegations as though fully set forth herein. 23 16.
