Further, in its Motion for Partial Summary Judgment, the Brookhaven Defendants refer to the Court granting a similar motion in another matter. (Def. Brookhaven’s Mot. Partial Summ. J. 8.) For reference, the matter referred to is Blevins v. Allen et al., Cause No. DC-20-10093 (116th Judicial District Court, Dallas County, Texas) (Parker, J.). A copy of the relevant documents from that matter are attached hereto. There, the plaintiff brought a wrongful-death action against a senior DEF.’S R. 58 ADOPTION OF BROOKHAVEN’S MOT. PARTIAL SUMM. J. PAGE 1 289358051V.1 living community, CHG Senior Living Preston Hollow, LLC d/b/a Crystal Creek at Preston Hollow (“CHG”), among others. (Ex. “A,” Pl.’s 3rd Am. Pet. ¶¶ 3, 4, 26-35, Blevins, Cause No. DC-20-10093.) CHG moved for partial summary judgment on Plaintiff’s claims under the Texas Wrongful Death Act, arguing that as a limited liability company, it was not an appropriate defendant. (Ex. “B,” CHG’s Mot. Partial Summ. J., Blevins, Cause No. DC-20-10093.) The Court granted CHG’s motion following briefing and argument of the parties. (Ex. “C,” Order Granting CHG’s Mot. Partial Summ. J., Blevins, Cause No. DC-20-10093.) Here, the Brookhaven Defendants make the same arguments as the Court agreed with in Blevins, and there are no materially distinguishing facts that would lead the Court to reach a different conclusion. Plaintiff in the instant lawsuit and the plaintiff in Blevins both allege that the respective defendant facility (both LLCs) was negligent in providing care to the respective decedents and seek damages under the Texas Wrongful Death Act. (Compare Pl.’s 2nd Am. Pet. 3-5, 11, with Ex. “A,” Pl.’s 3rd Am. Pet. ¶¶ 3, 4, 8-14, 26-35.) As such, the Court should follow its decision in Blevins and grant partial summary judgment on Plaintiff’s claims under the Texas Wrongful Death Act to both Defendant and the Brookhaven Defendants.
