I PRESENCE OF COUNSEL
If pro se Plaintiff, or Plaintiff’s counsel fails to appear for trial, then the complaint may be

the court may enter a default against Defendant.
IL. WITNESSES AND EXHIBITS
A list of the names and addresses of all witnesses to be presented at trial, and a list of all
exhibits to be entered into evidence at trial shall be forwarded to opposing counsel or pro se party
within fifteen (15) days of the date of this order. “Names” means a proper name (e.g., John Smith).
The vague, indiscriminate “any and all witnesses...” is not in compliance with this order. HSBC

Bank Mortg. Corp. United States v. Lees, 201 So. 3d 699, 701 (Fla. 4th DCA 2016)(Where a party
has failed to disclose the name ofa witness in accordance with a trial court order, the testimony of
that witness may be excluded at the trial court's discretion.). Similarly, exhibits must be identified
with particularity.
I. PRETRIAL MOTIONS
The case is “at issue” and all pretrial motions should have been filed and heard by now.
All pretrial motions must be filed and set for hearing at least 30 days prior to trial. Any motions
not timely filed will be deemed waived. Rule 1.220; Clark v. State, 985 So. 2d 637, 638 (Fla. 4th
DCA 2008)(the purposes of pretrial procedure orders regarding the timely filing of motions is to
avoid unnecessary delay of trials).
IV. COURT REPORTER
All trials must be reported. Counsel for the Plaintiff is responsible for having a court

V. CASE DISPOSITIONS
If at any time after the entry of this order, this case is dismissed, or results in a completed

the volume of cases pending, Counsel should not assume that the submission of a copy of the

VI. FACSIMILE TRANSMISSIONS
Pleadings or motions submitted to the Court may NOT be transmitted by facsimile, without
prior consent of the Judge’s Office.
If an attorney or party requires an order extending the life of their trial subpoenas, they may
submit one as needed.
