Plaintiff, U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE FOR THE AFC
MORTGAGE LOAN ASSET BACKED CERTIFICATES, SERIES 1999-1 (“U.S. Bank N.A.”),
pursuant to Florida Rule of Civil Procedure 1.260(c), moves for the substitution of U.S. BANK
TRUST COMPANY, NATIONAL ASSOCIATION, AS TRUSTEE, AS SUCCESSOR-IN-
INTEREST TO U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE FOR THE AFC
MORTGAGE LOAN ASSET BACKED CERTIFICATES, SERIES 1999-1 (“U.S. Bank Trust
Co., N.A.”) in the place of the current plaintiff, and states:
On September 20, 2022, U.S. Bank N.A. filed the instant foreclosure and, on December 6,
2022, filed the original note with the Court. Since then, the interest in the mortgage loan and
underlying promissory note has been transferred to U.S. Bank Trust Co., N.A. Therefore, while
Rule 1.260(c) provides the option of continuing as the original party—and the underlying trust
remains the same, with only the trustee changing—U.S. Bank N.A. wishes to substitute U.S. Bank
Trust Co., N.A. in its place for clarity of record, among other reasons.

Similarly, while likely not required, to avoid any claimed issues related to standing both
U.S. Bank N.A. and U.S. Bank Trust Co., N.A. seek the return of the original note and original
mortgage, filed with the Clerk of Court on or about December 6, 2022—-U.S. Bank Trust Co., N.A.
intends to present the Court with the original note at trial.
WHEREFORE U.S. Bank N.A. respectfully requests this Court enter an order substituting
U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, AS TRUSTEE, AS
SUCCESSOR-IN-INTEREST TO U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE
FOR THE AFC MORTGAGE LOAN ASSET BACKED CERTIFICATES, SERIES 1999-1 in its
place; adjusting the case style to reflect the new party-plaintiff; granting an Order returning the
original note to undersigned counsel, and granting such other and further relief as this Court deems
just and proper.
