NOTICE PURSUANT TO ARTICLE 2 OF THE NEW YORK EMINENT DOMAIN
PROCEDURE LAW FOR THE ACQUISITION OF CERTAIN REAL PROPERTY
LOCATED IN THE TOWN OF FALLSBURG, SULLIVAN COUNTY, NEW YORK
NOTICE IS HEREBY GIVEN to all persons that a public hearing, pursuant to Article
2 of the New York Eminent Domain Procedure Law ("EDPL"), will be held by the Town of
Fallsburg (the "Town") on Monday, August 23, 2021, beginning at 5:55 p.m., local time, at the
Senior Center, 12 Laurel Avenue, South Fallsburg, New York 12779.
In addition to informing the public, said public hearing is being held for the purpose of
"acquisition"
considering (i) the proposed by condernnation (as such quoted term is defined
under EDPL; hereinafter referred to as the "Acquisition") of all or a portion of certain "real
property"
(as such quoted term is defined under EDPL) located at 1500 State Route 52 E,
Liberty, New York (known as the Grandview Palace and/or Grandview Palace Condominiums
and identifiable by the tax identification numbers below) including, but not limited to, any
related private road(s), residential house(s), condominium unit(s), outbuilding(s), garage(s),
accessory structure(s) and/or related improvements thereon and/or thereat (collectively, the
"Proposed Site") in the Town of Fallsburg, Sullivan County, New York and (ii) the public
purpose of the proposed Acquisition, location of the Proposed Site, general effects of the
proposed Acquisition on the environment and the residents of the locality and other relevant
information. No proposed attemate locations are being considered.
The proposed Acquisition is required for and is in connection with a certain project
(collectively, the "Project") consisting of facilitating the productive use of such vacant and/or
underutilized Proposed Site through residential, municipal and/or commercial economic
development projects in connection with the public purposes of advancing the general
prosperity and econornic welfare of the residents of the Town by returning the vacant and/or
underutilized Proposed Site to productive use thereby promoting employment and increasing
the property tax base within the Town.
All interested persons are invited to attend said public hearing and present their views
regarding the proposed Acquisition. Persons unable to attend the public hearing, or persons in
attendance at the public hearing, may submit to the Town, either prior to, during or after the
public hearing, any written comments or other related documents regarding the proposed
Acquisition. Any written comments and related documents received by the hearing date or
within ten (10) calendar days of the public hearing will become part of the official public
hearing record. Written comments can be (i) sent to the Town of Fallsburg, c/o Supervisor
Steven Vegliante, 19 Railroad Plaza, South Fallsburg, New York 12779 or (ii) emailed to
grandview@fallsburgny.com. Comments will be accepted until the close of business on
Thursday, September 2, 2021; comments received after the close of business on Thursday,
September 2, 2021, will not be considered.
