REOPEN CASE AND SET ASIDE DISMISSAL
COMES NOW, U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE FOR THE
CERTIFICATEHOLDERS OF CSMC 2007-3, by and through the undersigned attorney, hereby moves
this Court for an order setting aside the order of dismissal filed on July 23, 2010 pursuant to Rule
1,540(b) and as grounds therefore, Plaintiff states the following:
1 This is a mortgage foreclosure action arising in Charlotte County, Florida.
2. This Court has jurisdiction to hear this matter pursuant to Rule 1.540. See, e.g. Miller v.
Fortune Ins. Co., 484 So. 2d 1221, 1222 (Fla. 1986) (holding that Rule 1.540(b) may be used
to afford relief to all litigants who can demonstrate the existence of the grounds set out under
the rule).
The undersigned was substituted as counsel for the Plaintiff and filed a Notice of Appearance
on or about April 26, 2010. See the docket attached herete.as Exhibit “A.”
On or about Septémber 24, 2010, this Court generated a notice setting the case for trial on
November 10, 2010.
Due to lack of notice by the court to Plaintiff’s counsel, Plaintiff's counsel did not attend the
trial and the court dismissed the case.
Although a Notice of Appearance was properly filed by Plaintiff, neither the notice of tial
being set nor notice of dismissal was served on Plaintiff. Plaintiff discovered the dismissal of
this case only by referring to the Court’s Docket.

7. Courts require that the record demonstrate a party's deliberate and contumacious disregard of the trial
court's authority, bad faith, or willful disregard or gross indifference to the trial court's orders before
going to the ultimate sanction, dismissal of a cause of action or striking a defendant's defenses:
something short of that is an abuse of discretion. Hetherington v, Donner, 786 So. 2d 9 (Fla. Dist. Ct.
App. 3d Dist. 2001).
Plaintiff respectfully requests this Court to consider Plaintiffs inadvertent failure to attend the trial
excusable due to lack of notice and set aside its order of dismissal.
WHEREFORE, Plaintiff requests that this Honorable Court set aside the final judgment of dismissal
and re-open this case.
