Upon the foregoing papers, the unopposed motion by incoming counsel for the
Defendant, seeking an Order substituting Christine A. Chester, Esq. (“Attorney Chester”), as
the attorney of record for the Defendants in this action in the place and stead of Joseph Falbo
Jr, Esq., deceased (“Attorney Falbo”), is GRANTED.
The Defendant, PETER BECHTEL, the President and Chief Operating Officer
for the corporate Defendants herein, proffers an affidavit wherein he attests, in pertinent part,
that he initially retained Attorney Falbo to represent him in this action. However, on June 14,
2023, Attorney Falbo advised the Court that he was ill and no longer able to represent the
Defendants in this action. Subsequently, Attorney Falbo passed away on July 2, 2023.
No opposition has been submitted to the within application to substitute counsel.

The Court finds the relief requested appropriate.

the place and stead of Joseph Falbo Jr, Esq., deceased; and it is further
ORDERED, that the parties and counsel are reminded to appear for the motion
nd Pre-Trial Conference previously scheduled for Monday, December 11, 2023 at 2:00
