AMENDED COMPLAINT
THIS ACTION came before the Court without a hearing on the Stipulation of Plaintiff,
HARRY BIEBERSTEIN, and Defendants, GABRIEL KIRCHBERGER, CAROL DEVILLE,
MOONSTONE HOLDINGS, LLC, and SOUTHERN SHORES ENTERPRISES, LLC, for entry
of an Order Granting Plaintiff Leave to File Revised Second Amended Complaint. The Court
has reviewed the stipulation and is duly advised in the premises. It is hereby ORDERED:
1 The Plaintiff's Motion for Leave to File Second Amended Complaint Adding
Additional Defendants is GRANTED as set forth herein.
2 The Revised Second Amended Complaint is hereby deemed FILED as of May 31,
2019.
3 Defendants, GABRIEL KIRCHBERGER, CAROL DEVILLE, MOONSTONE
HOLDINGS, LLC, and SOUTHERN SHORES ENTERPRISES, LLC, shall respond to the
Revised Second Amended Complaint within twenty (20) days of the date of this Order.

4 Upon payment of the applicable fee, the Clerk of the Circuit Court shall issue
summonses upon the Revised Second Amended Complaint to CHRISTINE FRAZER,
ANDREAS KIRCHBERGER, NICLAS X. KIRCHBERGER, and GOLDEN KEY
PROPERTIES, LLC. Plaintiff shall thereafter serve the summonses upon the Revised Second
Amended Complaint in accordance with Chapter 48 of the Florida Statutes who shall respond in
accordance with the Rules of Civil Procedure.
