State of New York ) County of Chenango ) ss: Kathy L. Black, being duly sworn deposes and says: 1. I am the Bank Officer of NBT Bank, National Association, the Plaintiff herein. I have personal knowledge of the books and records of said Plaintiff, and I am fully familiar with all of the facts and circumstances set forth herein. 2. On November 4, 2017, Defendant did execute and deliver a certain retail installment contract (hereinafter referred to as the "contract") to the seller and/or dealer described in said contract, in consideration of the purchase of certain personal property described in said contract. 3. The seller and/or dealer described in said contract duly assigned and delivered to Plaintiff the aforesaid contract for good and valuable consideration, and Plaintiff is now the owner and holder of said contract. 4. Defendant defaulted under the terms of the contract on July 18, 2020 by failing to pay to Plaintiff one or more monthly installments when due and that, by virtue thereof, Plaintiff elected to and did declare the outstanding balance immediately due and payable. 5. There is now due and owing to Plaintiff by Defendant the principal amount of $5,072.36, plus interest accrued thereon through May 4, 2021 in the amount of $405.94, plus interest accruing thereon after May 4, 2021 at the contractual rate of 7.57%, plus late fees accrued through May 4, 2021 in the amount of $196.05, and Plaintiff has been damaged in the total amount thereof. transaction" 6. This case does not arise from a "consumer credit as defined in 22 NYCRR Section 202.27-a(a)(1) (ie., revolving or open-end credit transaction to an individual primarily for personal, family, or househol pu oses).
