2 MEMORANDUM OF POINTS AND AUTHORITIES
3 Judicial notice may be taken of “[o]fficial acts of the legislative, executive, and judicial
4 departments of the United States and of any state of the United States.” (Evid. Code, § 452, subd.
5 (c).) Judicial notice may also be taken of “facts and propositions that are not reasonably subject to
6 dispute and are capable of immediate and accurate determination by resort to sources of
7 reasonably indisputable accuracy.” (Evid. Code § 452, subd. (h).) Where sufficient notice is
8 provided to adverse parties, and sufficient information is provided to the Court to take judicial
9 notice of a matter, judicial notice is mandatory. (Evid. Code § 453.)
10 The fact that a deed is recorded in the County’s official records is judicially noticeable as
11 an “official act” of the County of Santa Barbara. (Ragland v. U.S. Bank National Assn. (2012)
12 209 Cal.App.4th 182, 194 [“A recorded deed is an official act of the executive branch, of which
13 this court may take judicial notice.”])
14 Further, where recorded instruments are properly noticed and authenticity is not disputed,
15 judicial notice may be taken of the existence of the instrument, its facial contents, and any facts
16 that can be derived, or deduced, from the legal effect of the deed or statements therein. (San
17 Francisco CDC LLC v. Webcor Construction L.P. (2021) 62 Cal.App.5th 266, 281 [“Judicial
18 notice may be taken of the existence and facial contents of recorded real property records where,
19 as here, the authenticity of the document is not challenged”]; Julian Volunteer Fire Co. Assn. v.
20 Julian-Cuyamaca Fire Protection Dist. (2021) 62 Cal.App.5th 583, 600 [trial court did not err in
21 taking judicial notice of dates and legal effect of statements contained in deeds]; Yvanova v. New
22 Century Mortgage Corp. (2016) 62 Cal.4th 919, 925, fn. 1 [judicial notice of existence and facial
23 contents of recorded instruments mandatory where properly noticed].)
24 Thus, it is proper to take judicial notice of Exhibit A through Exhibit F, including their
25 contents. The Association respectfully requests that the Court take judicial notice of Exhibit A

As you know, we have not been able to informally resolve my/our view concerns in a mutually
acceptable way. As a result, pursuant to Hope Ranch Building Guideline §6.08, I am requesting

Hope Ranch HOA General Manager for an informal discussion of whether my/our view
concerns can be appropriately resolved and whether a written agreement about our resolution
can be agreed to between us as neighbors, including how the cost of any required tree trimming
may be shared and maintained in the future.
Under Hope Ranch Building Guideline section 6.08 (b) if you do not respond to this letter
within 30 days or if you decline to meet with me within 30 days, I will be entitled to ask that
my/our view concerns be reviewed and addressed by the Hope Ranch Board’s View
Committee.
