Index No. EF004587-2021 Dear Judge Zuckerman, As the Court will recall, I represent the plaintiffs in the above referenced Brian Comer and Brittney case, Davis. At the last conference I wrote in my notes that tomorrow's conference was at 9.30 am. However, I have now learned that it is in fact scheduled for 2:45 pm. I have an in-person trial in a family court case tomorrow at 3.30 that requires over an hour and so travel, I find myself with a conflict. As the Court knows, family court cases take precedence, and it is simply not possible for me to reschedule that appearance. Themeeting in the within case is a and, in addition, the parties are in the midst of conference, negotiating an out-of-court settlement which we expect to succeed without the need to go to trial. Opposing counsel has graciously agreed to an adjournment of the conference, and it is my hope that it can be arranged. I am a solo practitioner without a colleague to step in in my stead, and to retain a per diem attorney to appear in my stead at the virtual conference doesn't seem to serve much purpose under the circumstances. I apologize for this confusion, and I do hope that the conference can be adjourned. or, preferably. be rendered moot as we hope to reach an agreement.
