herein;
NOW, on motion of ROACH & LIN, P. C. , attorneys for
Plaintiff, wherein leave of this Court is sought for an Order
discontinuing the above entitled action, cancelling a certain
Notice of Pendency heretofore filed with the clerk of this court
heretofore filed on December 1, 2016, and vacating the Judgment of
Foreclosure and Sale duly signed on April 25, 2018 and entered on
April 30, 2018; and there being no opposition hereto; and this
application having come on to be regularly heard before me, and
after due deliberation having been held thereon, it is
ORDERED, that said motion is granted without opposition;
and it is further
ORDERED, that the above entitled action be and the same
is hereby discontinued without prejudice, without costs to either
party as against the other; and it is further
ORDERED, that the County Clerk of SENECA County is
directed, upon payment of the proper fees, if any, to cancel and
discharge a certain Notice of Pendency of this action filed in the
Office of the Clerk of the County of SENECA on December 1, 2016,
against property known as 5733 CHERRY HILL ROAD, ROMULUS, NY 14541,
Section 3, Block 1, Lot 85.122 and said Clerk is hereby directed
to enter upon margin of the record of same a Notice of Cancellation
referring to this Order; and it is further

dated April 25, 2018 and duly entered in the Office of the Clerk
of the County of SENECA on April 30, 2018 be vacated and set aside.
