Dear Honorable Judge Catena:
As you are aware, this firm represents the Plaintiff, Fairbridge Real Estate Investment
Trust, LLC f/k/a Realfi Real Estate Investment Trust LLC, in the above-referenced foreclosure
action.
During the last virtual conference with the Court on April 21, 2023, the parties were
directed to advise the Court of the status of settlement negotiations. While the Plaintiff's
representatives have personally met with Defendant, David Raven, to discuss a settlement of
action, to date, no settlement has been reached. The Plaintiff is presently finalizing a proposed
settlement agreement to be forwarded to Mr. Raven's attorney for approval.
However, based on Mr. Raven's failure to timely respond to Plaintiff's requests for
documentation and information, remit promised payments of money, as well as significant
questions concerning the veracity of Mr. Raven's representations to the Plaintiff concerning his
ability to satisfy the subject mortgage loan, Plaintiff is skeptical that a settlement will be
finalized.
