This matter comes before the Court on Receiver’s Motion filed on June 15, 2023.
Receiver, Peter Sciocchetti, through his attorney, Kimberly Van Wormer, Esq.,
requests that the Court permit the Receiver to distribute and release HUD funds to
Fairbridge Real Estate Investment Trust, LLC, F/K/A, Realfi Real Estate Investment Trust,
LLC, in the amount of $782,308.86; and authorize an interim commission payment of 5%
to the Receiver, pursuant to CPLR § 8004, in the amount of $41,174.15, as set forth in the
motion papers.
Upon review, the Court having considered all the papers filed in connection with
this motion, it is hereby
ORDERED that Receiver’s Motion to distribute and release HUD funds to
Fairbridge Real Estate Investment Trust, LLC, F/K/A, Realfi Real Estate Investment Trust,
LLC, in the amount of $782,308.86 is granted; and
ORDERED that Receiver’s Motion to authorize an interim commission payment
of 5% to the Receiver, in the amount of $41,174.15, is granted.
