WHEREAS, Plaintiff, JSJ HOLDINGS, LLC, having moved by and through its attorneys,
Duke Holzman Photiadis & Gresens, LLP, for an Order pursuant to CPLR § 3213 granting the entry
of judgment against the Defendants, AARDEE & SONS, INC., and JAYESH PATEL, jointly and
severally, and for such other, furtherand different relief as to the Court may be deemed just and
proper; and said moden having first come on to be heard before this Court at a Special Term held in
and for the County of Erie on September 8, 2021, with Robert C. Carbone, Esq. appearing for the
Plaintiff, and no appearance being made by the defendants; and
NOW, having read NYSCEF document numbers 1-15, and due deliberation having been had
thereon, it is hereby
ORDERED that Plaintiff's Motion for Summary Judgement seeking an award of money
damages in the amount of $33,474.92 for unpaid principal and accrued interest through May 31,
2021, plus accrued interest through the date of entry of judgment on September 21, 2021 in the
amount of $450.87 plus reasonable attorney's fees and costs as provided by contract in the amount
of $5,171.44, for a total sum of $39,097.23, against each Defendant AARDEE & SONS, INC. and
JAYESH PATEL, be and hereby is in all respects GRANTED; and it is further
ORDERED, that Judgment in the amount of $39,097.23, be entered by the Clerk of the Court
in favor of JSJ Holdings, LLC as against each Defendant AARDEE & SONS, INC. and JAYESH
PATEL, jointly and severally,
