                            FINAL ORDER OF DISMISSAL WITH PREJUDICE

               THIS CAUSE came before the Court upon the parties' Joint Motion and Stipulation for
        Dismissal with Prejudice, and the Court being otherwise fully advised in the premises, it is hereby:
               ORDERED and ADJUDGED that the Joint Motion and Stipulation for Dismissal with
        Prejudice be, and the same is hereby ratified, approved and confirmed, and the above-styled cause
        is hereby dismissed with prejudice as against Defendant, Michelin North America, Inc., with each
        party to bear their own attorneys' fees and costs. Plaintiff s claims against Discount Tire Co., are
        not affected by this dismissal.
