SECOND JOINT MOTION TO AMEND THE CASE SCHEDULE
Defendant State Teachers Retirement Board (STRB) and Plaintiffs Dean Dennis and Bob
Buerkle (Plaintiffs) (collectively the Parties) submit this joint motion asking this Court to amend
the case schedule. This Court entered an amended case scheduling order on October 18, 2022,
which contains an upcoming March 31, 2023, deadline for Plaintiffs to file their motion for class
certification. To date, the Parties have: (1) fully briefed STRB’s partial motion for judgment on
the pleadings, (2) exchanged and responded to written discovery, (3) implemented a joint ESI
protocol and met and conferred regarding document production, and (4) recently served additional
discovery requests. While the Parties have worked diligently and have advanced the litigation to
date, they note that the scope of discovery will likely be clarified following the resolution of the
pending motion for judgment on the pleadings. Thus, all Parties agree that a new case schedule
should be entered. This is the Parties second request to adjust the case scheduling order.
The Parties respectfully request this Court extend the dates contained in the October 18,
2022, amended case scheduling order by six months. This six-month extension would result in the
following dates
