                                MOTION FOR PARTIAL JUDGMENT ON THE PLEADINGS,
                                              FILED JANUARY 14, 2022

                          This matter is before the Court upon the Motion           for Partial Judgment on the

                  Pleadings filed by Defendant, State Teachers Retirement Board (hereinafter “Defendant

                   STRB”), on January 14, 2022.         No Memorandum Contra has been filed

                          Defendant STRB requests the Court, pursuant to Civ.R.         12(C), to dismiss Counts

                   1-5 and Count 7 of Plaintiffs’ Class Action Complaint.        However, on March 1, 2022, an

                   Agreed Order was filed granting Plaintiffs’ Unopposed Motion for Leave to File First

                   Amended Class Action Complaint.           Plaintiffs contended that they were seeking leave to

                   address the issues raised by Defendant STRB’s recently filed Motion for Partial Judgment

                   on the Pleadings

                          Therefore, based on the foregoing, and since Plaintiffs have now filed their First

                   Amended      Complaint, the Court accordingly hereby DENIES           AS MOOT       Defendant

                   STRB’s Motion for Partial Judgment on the Pleadings.

                          IT IS SO ORDERED.
