Proc., § 1250.310] 13 vs. Portions of APN: 062-0041-008 14 JASWINDER SINGH; HARMINDER 15 SINGH; DOES 1 through 30, inclusive; and all persons unknown claiming an interest in 16 the property described in the Complaint, 17 Defendants. 18 Plaintiff alleges as follows: 19 1 Plaintiff COUNTY OF SACRAMENTO (hereinafter “Plaintiff”) is, and at all 20 times herein mentioned was, vested by law, pursuant to Government Code sections 25350.5 and 21 Streets and Highways Code section 943 with the authority to exercise the power of eminent 22 domain to acquire property for public uses. 23 2 After due notice pursuant to Code of Civil Procedure section 1245.235, and prior 24 to the commencement of this action, the Plaintiff's Board of Supervisors, at a duly and regularly 25 convened public meeting on October 17, 2023, passed and adopted Resolution No. 2023-0843, a 26 Resolution of Necessity, (hereinafter the “Resolution”) declaring and determining that the public 27 28 -l- COMPLAINT IN EMINENT DOMAIN interest and necessity require the acquisition by Plaintiff of certain property interests described herein for South Watt Avenue Improvement Project (“Project”). 3 The Project will add 2 traffic lanes, 6 miles of sidewalks and bike lanes, create turnouts for future transit stops, improve 5 signalized intersections and replace Morrison Creek Bridge on South Watt Avenue between Florin Road and Jackson Road. These improvements meet current and expected increased travel demand and address safety concerns for commuters accessing other regional corridors and trucks traveling to and from several industrial and commercial facilities in the Florin-Perkins area and the regional freight highway that includes USS. 50, State Route 99, I-5 and I-80. This Project is the next critical step of improvements 10 proposed for the South Watt Avenue corridor, increasing the capacity of the roadway from a ll two-lane road to a four-lane road with bicycle, pedestrian, and transit accommodations. 12 4 Plaintiff's Board of Supervisors found and determined and declared in the 13 Resolution that: 14 (a) The public interest and necessity require the proposed project; 15 (b) The proposed project is planned and located in the manner that will be 16 most compatible with the greatest public good and the least private injury; 17 (©) The interest in the property sought to be acquired is necessary for the 18 project; and 19 (d) The offer required by Government Code section 7267.2 has been made to 20 the owners of record. 21 A copy of the Resolution with exhibits and attachments is attached hereto as Exhibit “A”, 22 incorporated herein and made a part of this complaint. 23 5 The Resolution was passed and adopted by more than a two-thirds vote of 24 Plaintiff's Board of Supervisors, and each and every matter, fact, and thing set forth therein is 25 and was true. 26 //1 27 1/1 28 2- COMPLAINT IN EMINENT DOMAIN 6 The property interests described herein and sought to be acquired by Plaintiff (hereinafter the “subject property”) consist of required Project easements across portions of a larger parcel. 7 The general location of the parcel on which the property interest is sought is 8971 Alder Avenue, Sacramento, California, in the County of Sacramento. A map showing the general location of the larger parcel within which the property is located is attached as Attachment “A” of Exhibit “A” and incorporated herein. 8 Plaintiff seeks to acquire an approximately 51 square foot public roadway and public utilities easement, an approximately 2,964 square foot public utilities and public facilities 10 easement and an approximately 7,469 square foot temporary construction easement across 11 portions of APN 062-0041-008 as part of its Project. 12 9 The legal descriptions of the easement areas to be acquired by Plaintiff across 13 portions of the larger parcel are set forth in Attachments “B”, “E”, and “H” to Exhibit “A” 14 attached hereto and incorporated herein. 15 10. Plat maps showing the location of the easement areas within the larger parcel are 16 attached as Attachment “C”, “F”, and “I” of Exhibit “A” hereto. 17 11. Scope of use language for the corresponding and respective easement interests 18 and temporary construction easement is set forth in Attachments “D”, “G” and “J” to Exhibit 19 “A” and incorporated herein. 20 12. Each defendant named herein appears of record or is known or believed by 21 Plaintiff to have a claim or interest in the property. 22 13. Plaintiff is informed and believes that the interests of Defendants as known to 23 Plaintiff, by way of example and not as allegations to which Plaintiff intends to be bound, are as 24 set forth below: 25 Defendant: Interest: 26 Jaswinder Singh Fee title 27 Harminder Singh Fee title 28 3. COMPLAINT IN EMINENT DOMAIN 14. Defendants named herein as Does 1 through 30, inclusive, have, or claim to have an interest in the property, the exact nature of which is unknown to Plaintiff at this time. The true names or capacities, whether individual, corporate, associate, or otherwise, of defendants named herein as Does 1 through 30, inclusive, are unknown to Plaintiff, which therefore sues such defendants by such fictitious names. Plaintiff will ask leave to amend this complaint to show the true names, capacities and interests of said defendants when the same have been ascertained. 15. Plaintiff also names as defendants all persons unknown claiming an interest in the property. 10 16. Plaintiff claims no preexisting interest in the property sought to be taken. 11 17. Plaintiff claims a lien interest for all property taxes and assessments as may be 12 due and payable on the date of possession. 13 18.
