STIPULATED ORDER GRANTING, IN PART, PLAINTIFFS’ EXPEDITED MOTION FOR CONTINUANCE OF DISCOVERY DEADLINES AND TO QUASH THIRD-PARTY SUBPOENA This matter comes before the Court on the expedited Motion of Plaintiffs APF — CRE I, LLC and APF — CPX I, LLC (collectively, “Plaintiffs”), successors in interest to Access Point Financial, LLC, f/k/a Access Point Financial, Inc. (“Access Point”), for an Order (i) continuing the discovery requests issued to Plaintiffs by Defendants Abhijit S. Vasani and Bhavna A. Vasani (collectively, “Defendants”), (ii) continuing the third-party depositions scheduled by Defendants, (iii) continuing the various third-party Civil Subpoenas issued by Defendants; and (iv) quashing the third-party Civil Subpoenas served on Access Point (the “Motion to Continue and Quash”) Following the Court’s review of the Expedited Motion and a status conference held before the above-captioned Magistrate Judge on September 22, 2022, IT IS HEREBY ORDERED THAT: 1 The Motion to Continue and Quash is hereby granted in part, subject to the terms of this Order. 2 The response deadlines for all discovery served by Defendants in this action on Plaintiffs and any and all third parties, including, without limitation, Access Point, are hereby Franklin County Ohio Clerk of Courts of the Common Pleas- 2022 Sep 23 3:07 PM-20CV007082 0GO95 - O5 continued until through and including Monday, October 31, 2022 (the “Continued Discovery Response Deadline”) in order to provide the Court with additional time to consider and rule upon Plaintiffs’ Motion (I) For Protective Order to Exclude Discovery Previously Served and (II) In Limine fo Exclude Argument or Evidence of Collateral Disposition (the “Motion in Limine”), filed in the above-captioned case on September 16, 2022, and any responses filed thereto; 3 Defendants’ counsel shall serve notices on all third parties served with discovery, including, without limitation, subpoenas, in order to provide notice of the Continued Discovery Response Deadline; 4 Defendants are permitted to continue serving subpoenas on additional third parties so long as the response deadline for such requests is no earlier than the Continued Discovery Response Deadline; and 5 Notwithstanding the foregoing, the Court reserves ruling on Plaintiffs’ and Access Point’s request, in the Motion to Continue and Quash, to quash the Civil Subpoena served on Access Point. Plaintiffs and Access Point hereby withdraw their request for expedited consideration on such request to quash, such request shall no longer be treated on an expedited basis, and shall be ruled upon in conjunction with the pending Motion in Limine. 6 Given the foregoing agreement between the Parties, the Court is amenable to further requests for a continuance of the Damages Hearing currently scheduled on January 18, 2023 at 9:30 a.m. upon a showing of good cause IT IS SO ORDERED.
