DAMAGES HEARING CONTINUANCE AND AMENDED SCHEDULING ORDER
This Damages Hearing Scheduling Order (this “Schedulin: Order”) is entered in
connection with the Damages Hearing scheduled in the above-captioned case pursuant to the
Court’s Entry Granting in Part Plaintiffs’ Motion for Partial Summary Judgment; Denying
Defendants’ Motion to Amend; and Denying as Moot Defendants’ Civ. R. 56(F) Motion (the
“Entry”). To establish a discovery plan, limit issues, and discuss other matters addressed by this
Scheduling Order, IT IS HEREBY ORDERED that:
1 DISCOVERY. Discovery in connection with the Damages Hearing (including,
but not limited to, written discovery, depositions, and any expert discovery) shall close on May
31, 2023.
2 EXPERT DISCOVERY, REPORTS AND DEPOSITIONS. All expert
discovery must be completed by the above discovery deadline. The parties (collectively, the
“Parties”) shall identify experts that are expected to testify at the Damages Hearing, as well as
produce any and all reports prepared by such experts in preparation for the Damages Hearing, no

later than April 30, 2023. Discovery depositions of all experts identified by the Parties shall be
completed no later than May 15, 2023.
3 PRETRIAL BRIEFING. The Parties are permitted to submit pretrial briefs for
the Court’s consideration no later than seven (7) days before the Adjourned Hearing Date (as
defined below).
4 WITNESS AND EXHIBIT LISTS. The deadline for the Parties to submit witness
and exhibit lists to the Court is three (3) business days before the Adjourned Hearing Date.
5 FINAL PRETRIAL CONFERENCE. A final pretrial conference may be held
before Magistrate Jennifer Cordle upon written request by the Parties.
6 ADJOURNED HEARING DATE. The Damages Hearing shall be held before
Magistrate Jennifer Cordle on June 27 and 28, 2023 at 9:30 a.m. (ET) in Courtroom 5D (the
“Adjourned Hearing Date”).
IT IS FURTHER ORDERED that the following PRACTICES and PROCEDURES shall
govern the terms and conditions of this Order:
7 DISCOVERY DISPUTES. The Parties shall meet and confer in person or by
telephone in a good-faith attempt to resolve any discovery disputes and, in the event the Parties
are unable to resolve such disputes, contact Judge Brown’s staff attorney to request a telephonic
hearing with the Magistrate Cordle, prior to filing any discovery motion. The Court will schedule
a telephonic hearing, if appropriate, or instruct the Parties to brief the matter.
8 PARTIES’ DUTY TO SUPPLEMENT DISCOVERY REQUESTS. Any and
all responses to discovery requests in this case, including without limitation responsive materials,
shall be supplemented by all parties as may be necessary or otherwise pertinent to the Damages
Hearing and in accordance with Rule 26(E) of the Ohio Rules of Civil Procedure no later than

April 4, 2023 and shall continue to be seasonably supplemented thereafter sufficiently in advance
of the Damages Hearing, including but not limited to in response to Plaintiffs’ First Set of
Interrogatories, Requests for Production of Documents, and Requests for Admission to
Defendants, which was served on Defendants on December 16, 2020, and in response to
Defendants’ First Combined Set of Requests for Admissions, Interrogatories, and Requests for the
Production of Documents to Plaintiff, which was served on Plaintiffs on August 29, 2022.
Except by further Order of this Court, the deadlines set forth by this Scheduling Order shall
not be amended. The Parties shall have the right to seek extension of the deadlines set forth in this
Scheduling Order for good cause shown
