Our conversation with them this week confirmed that they have identified additional relevant materials, which they are providing to our team this week to review for privilege and other objections, and prepare for labelling and production. Based on the volume of materials we have received and are receiving, we expect to continue rolling production of materials on or around Tuesday, January 17, 2023 (i.e., the date that we previously requested for an extension, after factoring in the federal holiday on Monday, January 16). We will of course keep you timely apprised of any changes to this estimate, as well any other developments as we complete our rolling production. As the continued hearing is now in April 2023, we are confident you will have ample lead time to review our clients’ production to prepare for the hearing and deal with any remaining discovery matters. If more time ends up being necessary for any valid reason, we will work with you on scheduling in good faith so that you and your clients are not prejudiced by the timing of our rolling document production and ongoing efforts to comply with your discovery requests.
