                                   PLAINTIFF'S NOTICE OF REMAND ORDER
                                          AND SIXTH CIRCUIT ORDER

                    The Tenth District Court of Appeals has remanded Plaintiff's appeal on its suggestion to

            this Court to resolve Plaintiff's Rule 59 Motion for a New Trial.   Defendants have submitted to

            this Court the Tenth District's Remand Order as well as a decision of the United States Court of

            Appeals for the Sixth Circuit affirming Judge Watson's decision in the United States District

            Court for the Southern District of Ohio.

                    Following entry of the Sixth Circuit's decision, Plaintiff on August 1, 2016 moved to stay

            the Sixth Circuit's mandate and enter emergency relief pending Plaintiff's seeking review in the

            United States Supreme Court. The Sixth Circuit on August 2, 2016 directed Secretary Husted

            and his co-defendants to respond to Plaintiff's Motion to Stay by 3:00 PM on Monday, August 8,

            2016.   A copy of the Sixth Circuit’s Briefing Letter is attached hereon as Exhibit “A.”   Should

            that stay be granted, the Sixth Circuit's decision will not take immediate effect.   Should it be

            denied, Plaintiff will immediately seek Supreme Court review.
