Sheehan Plaintiff, Permanent Parcel No. 129-18-092 -vs- Michael Gregory, et al., CONFIRMATION OF SALE (Private Purchaser) Defendants. This cause came on to be heard on the Report of Sale of the officer conducting the sale of property in the above entitled action and further described as Permanent Parcel 129-18-092, (See Legal Description attached Exhibit “A”) pursuant to the terms and conditions of this Court’s Order of Sale. (See Report of Sale attached Exhibit “B”). The Court finds that the said parcel was certified delinquent by the Office of the Fiscal Officer, for taxes, assessments, penalties, interest and other charges, if any, due, unpaid and payable to the Treasurer of Cuyahoga County, Ohio; that an action for foreclosure of liens for such delinquent land taxes was commenced by the County Treasurer; and, that a decree was issued by the Court in a Judgment of Foreclosure (Nonproductive Land), dated the March 7,2023, for the County Treasurer, for all taxes, assessments, penalties, interest and other charges, if any, which are payable on said parcel as of the date of this entry of Confirmation of Sale, and all allocated costs incurred in the proceedings. 1 The Court further finds that the amount of all such taxes, assessments, penalties, interest and other charges, if any, which are due, unpaid and payable for said parcel ((including the current taxes and assessments for the full year of 2022, plus any applicable penalties, plus any delinquencies for the tax year 2021 and prior)), is in the amount of Thirteen Thousand Fifty-Seven and 91/100, Dollars ($13,057.91) as of the date of this Confirmation of Sale and is payable to Cuyahoga County Treasurer; that the total of all allocated costs incurred in the proceedings is in the amount of One Thousand Four Hundred Seventeen and 50/100, Dollars ($1,417.50); and, that further said sums together are in the amount of Fourteen Thousand Four Hundred Seventy-Five and 41/100, Dollars ($14,475.41) and constitute the total amount of the Findings of this Court, is the "Minimum Bid" as defined by the statutes of Ohio, and was the bid proposed by the Sheriff as the minimum bid for said parcel at the time said parcel was offered for sale at the Sheriffs sale. The Court further finds that the total of all allocated costs incurred in the proceedings, as set forth above, includes: the cost of the Judicial Report, as submitted by the Prosecuting Attorney of Cuyahoga County, Ohio, which is in the sum of $475.00 and is payable to Cuyahoga County; all allocated court costs which will be incurred in the entire proceedings for this parcel as submitted by the Clerk of this Court, which are in the sum of $487.58 and is payable to, Clerk of Court; and, Sheriffs fees and costs as set forth in said Report of Sale, which are in the sum of $454.92 and is payable to Cuyahoga County Sheriff. The Court further finds that an Order of Sale (Nonproductive Land) dated August 7,2023, in the within case was issued to the Sheriff directing him to advertise and sell said parcel according to the tenor of the said Judgment of Foreclosure and in the manner provided by law for the sale of real property on execution and according to Section 5721.19 and 5722.03, where applicable, of the Ohio Revised Code, and according to the Rules of the Common Pleas Court of Cuyahoga County, Ohio; 2 and, for not less than the total amount of the Findings of the Court which shall constitute the "Minimum Bid". The Court further finds that the Sheriff did advertise said parcel for sale once a week for three (3) consecutive weeks in the Daily Legal News; that a copy of the Notice of Foreclosure Sale as published was attached to the said Report of Sale submitted by the Sheriff to the Court with an affidavit of publication by said newspaper; and, that said notice of foreclosure sale was substantially in the form of the notice set forth in Section 5721.191 of the Ohio Revised Code. The Court further finds that said notice of foreclosure sale did set forth that the sale of said parcel would be public, for cash, and would be sold to the highest bidder with a bid sufficient to satisfy the "Minimum Bid" as set forth herein. The Court further finds that said notice of foreclosure sale did include that the sale on said parcel was to commence at the hour of 9:00 a.m. on September 6, 2023 at https://cuyahoga.sheriffsaleauction.ohio.gov/ , and should the Sheriff not receive a bid at the first sale of said parcel sufficient to satisfy the "Minimum Bid", the Sheriff would again offer said parcel for sale at a second sale, under the terms and conditions of the first sale, at the same time of day and at the same place, on September 20, 2023. The Court further finds that the Sheriff did separately offer said parcel for sale, without appraisal, at public sale in the manner provided by law for the sale of real property on execution and according to Sections 5721.19 and 5722.03, where applicable, of the Ohio Revised Code, and, according to the applicable Rules of this Court. 3 The Court further finds that said parcel was sold to Purchaser(s): BLUE DIAMOND REAL ESTATE GROUP LLC Address: 5523 EAST 141ST, Maple Heights, OH 44137 on September 20, 2023, at said public sale, for the sum of Fourteen Thousand Four Hundred Seventy-Five and 41/100, Dollars ($14,475.41), said purchaser(s) offering the highest and best bid for the parcel, and said sum being for not less than the total amount of the Findings of the Court, that is, the "Minimum Bid". WHEREFORE, the Court being satisfied that the sale has been in respects in conformity to the law and the order of this Court, as reported by the Sheriff in his said Report of Sale, hereby Approves and Confirms the sale. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that upon the payment of the purchase price (bid), the Sheriff of Cuyahoga County, Ohio, shall execute and deliver a good and sufficient Deed to the said purchaser(s): BLUE DIAMOND REAL ESTATE GROUP LLC It is further ORDERED that from the proceeds of said sale the Sheriff shall, in making his distribution according to said Judgment of Foreclosure entered in this case, pay the sums of money set forth herein, to the parties as are herein set forth in the Findings of this Court in this Confirmation of Sale entry. It is further ORDERED, ADJUDGED AND DECREED that the equity of redemption is extinguished and that any parties defendant owning or claiming any right, title, or interest in, or lien upon said parcel, together with such who may have right of dower, shall be and they are hereby forever barred from asserting any right, title or interest in, or lien upon the said parcel. 4 It is further ORDERED by the Court that a certified copy of this Confirmation of Sale be issued and delivered to the Sheriff of Cuyahoga County, Ohio, Civil Division; to the Office of the Fiscal Officer, Real Property Department; and, to the Treasurer of Cuyahoga County, Ohio.
