On this date, came to be considered the above-entitled and numbered cause wherein the State of
Texas by and through the Criminal District Attorney of Hidalgo County, Texas, as Plaintifi‘, alleged that
it had seized ELEVEN THOUSAND EIGHT HUNDRED TWENTY-FOUR AND 00/100
DOLLARS ($11,824.00) IN UNIITED STATES CURRENCY; ONE (1) 2008 FORD F-250
TRUCK VIN 1FI‘SW21538ED76221; ONE (l) 2007 CHEVROLET VAN VIN
lGCFG15X871185128; and ONE (l) 2004 CHEVROLET AVALANCHE VIN
3GNEK12T34GZ94807, alleged in the Original Petition and Notice of Seizure and Intended Forfeitum
filed herein.
The court finds that citation and certified copy of Plaintifi’s Original Notice and Intention to Forfeit
was duly and personally served on PRO SE respondent BRENDA B. BELTRAN, and that said citation
was returned to the Clerk of the Court where it has remained on file for the time required by law.
PRO SE Respondent BRENDA B. BELTRAN, having filed an answer.
The court finds that citation and certified copy of Plaintifi’s Original Petition and Notice of Seizure
RODOLFO GARCIA OSORIO; JOSE
and Intended Forfeiture were duly and personally served on

The court finds that no answer has been filed herein by the above-named defendant and that the
defendant has failed to appear and has wholly made default.

(l) 2004 CHEVROLET AVALANCHE VIN 3GNEK12T346294807 should be forfeited to the
Criminal District Attorney of Hidalgo County, Texas as agent for the State of Texas and the MISSION
POLICE DEPARTMENT, pursuant to the parties’ local agreement.
The Court, afier duly considering of the opinion and so finds that
the evidence and the law, is

contraband as defined in the Texas Code of Criminal Procedure, Article 59.01(2). The court further
finds that the said ELEVEN THOUSAND EIGHT HUNDRED TWENTY-FOUR AND 00/100
DOLLARS ($11,824.00) IN UNIITED STATES CURRENCY; ONE (l) 2008 FORD F-250
TRUCK VIN lFTSW21538ED76221; ONE (l) 2007 CHEVROLET VAN VIN
lGCFGlSX87ll85128; and ONE (1) 2004 CHEVROLET AVALANCHE VIN
3GNEK12T34GZ94807, were used or intended to be used in violation of the Texas Controlled
Substance Act, Chapter 481 of the Texas Health and Safety Code. Plaintiff, pursuant to Articles
59.01(2), 59.05(e) and 59.06 of the Texas Code of Criminal Procedure, requests ELEVEN
THOUSAND EIGHT HUNDRED TWENTY-FOUR AND 00/100 DOLLARS ($11,824.00) IN
UNIITED STATES CURRENCY; ONE (1) 2008 FORD F-250 TRUCK VIN
lFI‘SW21538ED76221; ONE (l) 2007 CHEVROLET VAN VIN lGCFG15X87l 185128; and ONE
(l) 2004 CHEVROLET AVALANCHE VIN 3GNEK12T34G294807, subject of this suit, be forfeited
to the Criminal District Attorney of Hidalgo County as agent for the State of Texas and the Mission
POLICE DEPARTMENT, pursuant to the parties’ local agreement;
a) It is ORDERED, ELEVEN THOUSAND EIGHT HUNDRED TWENTY-
that the

DISTRICT ATTORNEY and the MISSION POLICE DEPARTMENT, pursuant
to the parties’ local agreement.
IT IS ORDERED that the ONE (l) 2008 FORD F-250 TRUCK VIN lFTSW21538ED76221;
ONE (1) CHEVROLET
2007 VAN VIN lGCFGlSX871 185128; and ONE (l) 2004 CHEVROLET
AVALANCHE VIN 3GNEK12T34G294807, herein referred to as the “subject vehicle”, the subject of
this suit, shall be forfeited to the CRIMINAL DISTRICT ATTORNEY OF HIDALGO COUNTY,
TEXAS as agent for the State of Texas and the MISSION POLICE DEPARTMENT pursuant to the
parties local ageement; to be used for Law Enforcement purposes.
IT IS FURTHER ORDERED that the “subject vehicle” be released INSTANTER to the
CRIMINAL DISTRICT ATTORNEY OF HIDALGO COUNTY, TEXAS as agent for the State of
Texas and the MISSION POLICE DEPARTMENT, pursuant to the parties’ local agreement; and the
State Department of Highway and Public Transportation is ordered to issue valid certificate of title to the
CRIMINAL DISTRICT ATTORNEY 0F HIDALGO COUNTY, TEXAS as agent for the State of
Texas and the MISSION POLICE DEPARTMENT, pursuant to the parties’ local agreement; for the
“subject vehicle”.
IT IS FURTHER ORDERED that in the event the “subject vehicle” is to be sold at auction by the
CRIMINAL DISTRICT ATTORNEY OF HIDALGO COUNTY, TEXAS as agent for the State of
Texas and the MISSION POLICE DEPARTMENT, pursuant to the parties’ local ageement; pursuant
to the Texas Transportation Code and/or the Texas Code of Criminal Procedure, the Texas Department
0f Motor Vehicles is ordered to issue valid certificate of title to the PURCHASER of the “subject
vehicle” subsequent to the sale at auction.
IT IS FURTHER ORDERED, ADJUDGED AND DECREED AJ] relief not expressly granted is
