Stat. § 5043.361 WRIT OF RECOVERY OF PREMISES To the Sheriff of the County: On December 01, 2022, this Court entered judgment against the Defendant. The Plaintiff is entitled to recovery from the Defendant of the following premises (describe the premises as in the complaint): 1302 Birch Street Apt #203 Marshall MN 56258 The Sheriff shall remove the Defendant from the premises, using the force of the county if necessary, and return the premises to the Plaintiff according to the procedure set out in Minn. Stat § 5048.365. The Sheriff shall return this writ to the court administrator within 30 days. This D is OR m is not a priority writ under Minn. Stat. § 5048.365, subd. 2. ORDER TO VACATE Based upon the findings and conclusions in the above referenced case, the Court ORDERS: The Defendant, any adult members of the Defendant's family occupying the premises, and any other person in charge, shall remove themselves and their family and all their personal property from the premises. They must do so within 24 hours after the officer's service or posting of this writ upon the premises. If the Defendant cannot be found in the county and no person is in charge of the premises, then after the expiration of the 24-hour period, the officer shall enter the premises, breaking in if necessary, and remove and store Defendants' personal property as provided in Minn. Stat. § 504B.365, subd. 3.
