Klein v. ORDER ON MOTIONS IN LIMINE Guadalupe Gomez, James Gomez, Temaca Lawn Sprinkler's, Inc., d.b.a. Temaca Lawn Sprinklers, Defendants. This matter came before the Honorable Joseph R. Klein, Judge of District Court, on January 8, 2020, on the parties’ pre-trial Motions in Limine. All appearances are as noted on the record. Based upon the files, records, and proceedings herein, and the arguments of the parties, the court makes the following: ORDER 1. Plaintiff’s Motion in limine is GRANTED. 2. Defendants’ Motion in limine is DENIED. 3. The parties have waived their right to submit their claims to binding arbitration. 4. The pleadings in this matter shall constitute: 1. Plaintiff’s Complaint, dated November 27, 2018; and 2. Defendants’ Answer, titled by Defendants as “Response to Plaintiff’s Request for Temporary Injunction, Answer to Plaintiff’s Verified Complaint and Defendant’s Motion for Temporary Relief and Defendant’s Verified Complaint,” dated December 12, 2018. 5. The only claims in this matter are those in Plaintiff’s November 27, 2018 Complaint. The only defenses raised by Defendants are those in Defendants’ December 12, 2018 Answer. 27-CV-18-19659 Filed in District Court State of Minnesota 3/11/2020 11:11 AM 6. No evidence may be introduced that is not directly relevant to the aforementioned pleadings. 7. This matter is set for a court trial on a date certain of April 20, 2020.
