Review Recommendations
CARP makes recommendations based on the facts and findings of the case. Recommendations in this report seek to safeguard the
assets of the person subject to conservatorship and provide accurate accountings to the court. The conservator may receive further
instruction from the court as a result of this report.
Recommendation to the Court :
The 2nd Annual Account has been placed in amendment status. The court should ensure the Amended Annual Account is filed
within 30 days, unless a different filing deadline is directed by the court.
The current bond coverage should be re-evaluated.
Recommendation to the Conservator :
The 2nd Annual Account has been placed in amendment status. The conservator should complete the adjustment below and
submit the amended account within 30 days or within the time frame determined by the court. For assistance with the adjustment,
please contact the Conservator Helpline at (763) 347-4437.
The annual account includes a Gerald Enos Note $125,000 account with an ending balance of $52,936.47. According to the
amortization schedule, the September 2021 balance was $43,554.20. This error resulted from the conservator incorrectly
reporting and omitting transactions on the annual account. To correct the error, the conservator should enter an expense
transaction in the amount of ($9,382.27) categorized as "CARP Review Expense Adjustment" to accurately reflect the
balance of bondable assets. On the 3rd Annual Account, the conservator should provide an updated statement reflecting the
current balance owed to the person subject to conservatorship.
Going forward, the conservator should review the annual accounting before the submission process in MyMNConservator (MMC)
to ensure all transactions are reported correctly.
Bond
The adjusted ending balance of bondable assets of the person subject to conservatorship is $399,662.31 and currently there is a
$50,000.00 bond posted on this account. In accordance with Minnesota State Statute 524.5-416(a)(5) and the decision in the
Guardianship and Conservatorship of Jeraldine J. Pates, Minn. Ct. App. A12-0660 (Nov. 13, 2012), a bond shall be posted on accounts of
$10,000.00 or greater.
Scope
The CARP Reviewer considered information from the Minnesota Court Information System (MNCIS), MyMNConservator (MMC), in
addition to requested information/documentation provided by the conservator for the period ending October 2, 2021 (2nd Annual
Account).
