                        AND TO REOPEN DISCOVERY

TO THE HONORABLE JUDGE OF SAID COURT:

        NOW COMES Defendant CEMPLEX GROUP TEXAS, LLC (Cemplex) and joins in

Defendants Builder Services Group d/b/a Williams Fireplaces and Gutters, Performance Piping,

Inc., and Aquatek Systems, Inc.’s Motion for Enlarged Jury Panel and to Reopen Discovery.

Cemplex further provides the Court with the following briefing related to alignment of the parties

and allotment of peremptory strikes.

                                                I. BACKGROUND.

        This action was initiated by Plaintiff Mondara Condominiums Association, Inc., by

asserting claims   of negligence, breach of the Uniform Condominium Act, breach of express and

implied warranties, breach of fiduciary duties, negligent misrepresentation, Violations of the

Deceptive Trade Practices Act (DTPA), estoppel/fraudulent concealment, fraudulent transfers

under the Texas Uniform Fraudulent Transfer Act, and civil conspiracy against the Defendants.

As   to Cemplex (and the other named Defendants who were involved in the Mondara

Condominiums project as subcontractors), Plaintiff has asserted claims of negligence, breach of

express and implied warranty, breach              of the uniform condominium act, and Violations of the

DTPA, essentially alleging Cemplex failed                   to perform its work in a good and workmanlike

manner. Cemplex has asserted cross-claims against Stillwater                        GC, LLC and Stillwater Abbott

Development,    LLC for contractual indemnity and breach of contract.                    Stillwater GC,       LLC has also
asserted cross-claims against Cemplex for contribution, negligence, breach                             of contract,    and


indemnity.

                                           II. LEGAL AUTHORITY.

        Generally, each party in a civil action in district court is entitled to six peremptory strikes.

Tex. R. Civ. P. 233; Moore v. Altra Energy Techs., Inc., 321 S.W.3d 727, 740-41 (Tex. App.—

Houston [14th Dist] 2010, pet. denied). But in a multiparty case, before allocating peremptory

challenges, it is the trial court’s duty to decide whether any of the litigants aligned on the same

side of the docket are antagonistic with respect to any issue submitted to the jury. Tex. R. Civ. P.

233; Garcia v. Cent. Power & Light Co., 704 S.W.2d 734, 736 (Tex. 1986); Van Allen v.

Blackledge, 35 S.W.3d 61, 64 (Tex. App-Houston [14th Dist] 2000, pet. denied). In allocating

peremptory challenges when multiple litigants are involved on one side of a lawsuit, a trial court

must determine whether any of those litigants are antagonistic with respect to an issue of fact that

the jury   will decide. Garcia        v. Cent.   Power & Light Co., 704 S.W.2d 734, 736 (Tex.l986). If

there is no antagonism between litigants on the same side, then each side must receive the same

number     of strikes. Garcia, 704 S.W.2d             at 736. In determining antagonism, the trial court must

consider the relevant facts and circumstances of the case including the pleadings, information

disclosed by pretrial discovery, information and representations made during voir dire, and other

information brought to the trial court's attention. Patterson Dental Co. v. Dunn, 592 S.W.2d 914,

919 (Tex.1979). “When antagonistic parties on the same side are required to share six strikes, it

is error amounting to a violation of the basic right to trial by jury.” Id. at 918.

                                    III. APPLICATION TO THIS CASE.

        Defendant Cemplex was retained by Defendants Stillwater GC,                        LLC and Stillwater Abbott

Development,    LLC to install sound mat and light weight concrete in the Mondara Condominiums.
Stillwater GC has asserted a cross-claim against Cemplex, and Cemplex has asserted cross-claims

against both Stillwater GC and Stillwater Abbott Development. Cemplex, Stillwater GC, and

Stillwater Abbott Development have an interest in not only producing evidence of their own

defenses against Plaintiff’s claims, but in producing evidence to prevail on their competing cross-

claims. As a result, Cemplex, Stillwater GC, and Stillwater Abbott Development are antagonistic

towards each other, and it would be error to require Cemplex, Stillwater GC, and Stillwater Abbott

Development to share peremptory challenges. See Patterson Dental, 592 S.W.2d at 918. This is

also true with Stillwater GC and the other subcontractor defendants remaining in the case because

Stillwater GC’s cross-claim is against all subcontractors. Accordingly, in considering the size of

the jury pool needed for this case and the number                 of peremptory strikes to allot to the parties, the

Court should consider the antagonistic relationship between the Stillwater Defendants and the

subcontractors.

        WHEREFORE, PREMISES CONSIDERED, Defendant CEMPLEX GROUP TEXAS,
LLC respectfully requests the Court request an enlarged jury pool of 100 potential jurors, make a

proper alignment of the parties in assigning peremptory challenges, and reopen discovery.

Defendant further requests all other relief, legal or equitable, to which it may show itself justly

entitled.
