ELLIOTT, INDIVIDUALLY Defendants. DALLAS COUNTY PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INC.’S RESPONSE TO DEFENDANTS’ MOTION FOR AN ENLARGED JURY PANEL AND TO REOPEN DISCOVERY TO THE HONORABLE JUDGE OF SAID COURT: COMES NOW, Plaintiff, Mondara Condominiums Association, Inc. (”Mondara”), and files this, its response to Builder Services Group d/ b / a Williams Fireplace and Gutters, Performance Piping, Inc., and Aquatek Systems, Inc. (collectively, the ”Defendants”) Motion for an Enlarged Jury Panel and to Reopen Discovery, and in support thereof, would respectfully show the Court as follows: I. Enlarging the Jury Panel Should not be Done at the Expense of the Trial Date Mondara is not opposed to the suggestion that the jury panel should be enlarged; however, it objects to enlarging the panel at the expense of the specially set trial date. This trial has been specially set since December 2022, with the jury panel of 60 also set at this time. As the Court explained on Thursday, the Court needs six weeks to request a jury panel, which would require the trial date to be bumped by at least that amount of time. The Defendants had an opportunity to provide input when the trial date and jury panel PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INc.’s RESPONSE 1 TO DEFENDANrs’ MOTION TO ENLARGE JURY POOL AND REOPEN DISCOVERY were discussed initially. They also had an opportunity to request a larger panel at any point after it was set. To do so now is an attempt to needlessly delay the trial. The Defendants’ suggestion that each party have 3-4 strikes disregards Texas Rule of Civil Procedure 233 ”Number of Peremptory challenges” and ignores the fact that most of the defendants’ interests in this case are aligned. Rule 233 first requires the Court, in multi-party cases, to determine ”Whether any of the litigants aligned on the same side of the docket are antagonistic with respect to any issue submitted to the jury. . ..” Then, upon the motion of any party—which Plaintiff moves herein—the trial judge must “equalize the number of peremptory challenges so that no litigant or side is given unfair advantage. ..” The existence of antagonism is a question of law. Garcia v. General Power 8 Light Co., 704 S.W.2d 734, 736 (Tex. 1986). “The existence of antagonism must be determined after voir dire and before the exercise of the peremptory challenges.” Holland v. Lovelace, 352 S.W.3d 777, 787 (Tex. App—Dallas 2011, pet. denied). ”In determining antagonism, the trial court must consider the relevant facts and circumstances of the case including the pleadings, information disclosed by pretrial discovery, information and representations made during voir dire, and other information brought to the trial court‘s attention.” Id. In this case, there is no antagonism among certain groups of defendants— particularly those who are represented by the same counsel and who have acted in lockstep among one another throughout the course of this lawsuit. Where groups of defendants have not displayed antagonism and where their jury strikes will be determined by the same attorney, their jury strikes should be shared. Thus, the number of total strikes required would be far less than what is predicted and requested by the Defendants. PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INc.’s RESPONSE 2 To DEFENDANTs’ MOTION TO ENLARGE JURY POOL AND REOPEN DISCOVERY In most cases a two-to-one ratio between sides would approach the maximum disparity allowable when equalizing jury strikes. Patterson Dental C0. v. Dunn, 592 S.W.2d 914, 920 (Tex. 1979). Yet the Defendants’ suggestion of 3-4 strikes per party does not comply with Rule 233 and would allocate nearly 4 times the number of strikes to one side (Defendants) than to the other (Plaintiff). This would far exceed the Court’s discretion to equalize jury strikes. ”The process of equalizing the strikes is not without limits and is not subject to the unlimited discretion of the trial judge.” Id. Once the Court has determined the existence of antagonism among the Defendants, any concerns about busting the venire pool should be resolved in a reduction of total strikes if it is not possible to enlarge the panel. Delaying trial causes prejudice to Plaintiff who filed this lawsuit 3 years ago and who has spent substantial time and resources preparing for the specially set trial, while properly equalizing peremptory strikes among the parties and reducing the total number of peremptory strikes does not give an unfair advantage or prejudice any party. II. The Defendants Already had an Opportunity to Conduct Discovery about LGT The Texas Supreme Court has laid out nonexclusive factors to determine whether a trial court should reopen discovery. ”We have considered the following nonexclusive factors when deciding whether a trial court abused its discretion in denying a motion for continuance seeking additional time to conduct discovery: the length of time the case has been on file, the materiality and purpose of the discovery sought, and whether the party seeking the continuance has exercised due diligence to obtain the discovery sought. [06 v. Two Thirty Nine Ioz'nt Venture, 145 S.W.3d 150, 161 (Tex. 2004). The Defendants assertions that LGT Contractors, LLC (”LGT”) is a new party and there has not been a chance to conduct discovery is patently false. Mondara first added LGT as a defendant in its Second PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INc.’s RESPONSE 3 To DEFENDANTs’ MOTION TO ENLARGE JURY POOL AND REOPEN DISCOVERY Amended Petition on February 2, 2021, which is the same date the Defendants were added. Documents regarding LGT’s involvement were produced with Stillwater’s first production. At four separate depositions, Mondara questioned deponents about LGT, none of the Defendants took advantage of that opportunity. Finally, each of the Defendants has listed LGT as a knowledgeable party. Under the Two Thirty Nine Ioint Venture factors, the Defendants’ motion to reopen discovery should be denied. The Stillwater Entities have produced documents showing the extent of LGT’s involvement in the Project back in October 2020. Those documents include the certificate of insurance showing LGT doing business as Stillwater GC, LLC, and invoices from the waste removal company and porta potty subcontractor (which is not a party to this case) addressed to “Stillwater Cap / LGT” in late 2016. The point of contact on those invoices were Gary Hamilton and Troy English - during the time they were employed by Stillwater GC. No Defendant has used these documents as exhibits during motions or depositions or identified them as trial exhibits. There were numerous opportunities for the parties to ask questions about LGT at depositions. Mondara was the only party to do so. The first person asked was Steven King, on June 24, 2022. Mr. King was presented Savannah’s responses to Mondara’s requests for disclosures where Savannah identified LGT as a knowledgeable party and asked, ”do you know who that is?” He did not. Steve King Depo p. 46:16-21. Robert Elliott was asked about LGT on October 3, 2022 on two separate occasions, both by Mondara.” Elliott stated that LGT is Stillwater GC. ”Who is LGT?” ”My understanding is that that is Stillwater General Contractors. It just had an earlier name, so the same GC company is LGT and then moved into Stillwater General Contractors. That’s my understanding of who LGT is. ” PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INc.’s RESPONSE 4 To DEFENDANTs’ MOTION To ENLARGE JURY POOL AND REOPEN DISCOVERY ”What does LGT stand for?” ”Luke Garrison Taylor. It’s just three initials of sons of myself and Aaron. ” ”Oh, you and Aaron?” ”Yeah. Not Together. Aaron has a son; I have two sons. ” ”So it was just a way of designating an entity that you’re associated with; is that correct?” ”Yes, to be a general contractor. That was the — that’s when we set it up, and I don’t know when that was set [up].” Robert Elliott, October 3, 2022 Deposition p. 95:10-96:1 ”Now, LGT, is it your position that that’s, in reality, Stillwater GC; is that your understanding?” ”That is my understanding, yes.” Robert Elliott — October 3, 2022 Deposition p. 132:1-3. Gary Hamilton, who worked for Stillwater GC and was the person listed as a point of contract by the waste removal company, was asked if he had ever heard of LGT on February 2, 2023. He couldn’t recall. See Hamilton Depo p 76:16-17. Finally, Alex Maki, the Stillwater Capital CFO was asked about LGT on August 14, 2023. He confirmed that LGT was owned by Stillwater Capital Investments, and ”did small projects” but ”at this point, it does nothing really.” Supporting Elliott’s testimony from October 2022. Alex Maki — August 14, 2023 Deposition p 120:5-20. The Defendants’ claims that discovery is necessary to determine LGT’s involvement merely an attempt to delay this trial. Documents were produced at the onset of this case by the Stillwater Entities that showed LGT’s involvement. Multiple people with knowledge of LGT were deposed and testified about LGT. No defendant asked questions about LGT of those deponents. Each of the Defendants listed LGT as a PLAINTIFF MONDARA CONDOMINIUMS ASSOCIATION, INc.’s RESPONSE 5 To DEFENDANTs’ MOTION To ENLARGE JURY POOL AND REOPEN DISCOVERY knowledgeable party in their Request for Disclosure Responses and did nothing to determine the extent of that knowledge. For the Defendants to now claim they were not afforded an opportunity to conduct discovery is false. The Defendants’ have not satisfied the Two Thirty Nine Joint Venture factors, and any attempt to delay the trial based on a need to reopen discovery regarding LGT should be denied.
