LISA MASSIMI, an attorney duly admitted to practice law in the State of New York,
hereby affirms the truth of the following under penalty of perjury:
1. I am an Associate in the law firm of Caruso Smith Picini PC, attorneys for Defendant
Yardley of London, LTD and submit this affirmation in support of the undersigned’s application
pursuant to Rule 1250 ( e) of the Practice Rules of the Appellate Division and 22 N.Y.C.R.R.
520.11 (Rules of the Court of Appeals), for the pro hac vice admission of Richard D. Picini to this
Court for the purpose of participating in pretrial proceedings and trial of the above-referenced
matter.
2. Upon information and belief, the sources of which are my own conversations with Mr.
Picini and the accompanying Affidavit of Richard D. Picini, sworn to on April 6, 2023, (the “Picini
Affidavit”), Mr. Picini is a Partner at Caruso Smith Picini PC and a member in good standing of
the Bars of the State of New Jersey (admitted 1983) and the United States District Court for the
District of New Jersey (admitted 1983). Certificates of Good Stating from the Supreme Court of
New Jersey and the United States District Court for the District of New Jersey are annexed to the
Picini Affidavit as Exhibits 1 and 2, respectively.
3. As shown in the accompanying Picini Affidavit, Mr. Picini is familiar with and agrees
to be bound by the standards of professional conduct imposed upon members of the New York

State Bar and, if this application is granted, he subjects himself to the jurisdiction of the courts of
New York with respect to any acts occurring during the course of his participation in this matter.
4. I am a member in good standing of the New York Bar and consent to the association of
Mr. Picini for purposes of this litigation. I will remain the attorney of records for Defendant
Yardley in this matter and will remain primarily responsible for the conduct of the case.
5. It is respectfully submitted that there is good cause to admit Mr. Picini pro hac vice in
this matter because of his ongoing attorney-client relationship with Defendant Yardley and his
intimate knowledge of the facts and legal issues in this matter.
6. For the Court’s convenience, a draft Order granting this request is attached hereto as
Exhibit A.
WHEREFORE, Defendant Yardley, respectfully requests that this Court specially admit
Richard D. Picini pro hac vice for the purpose of participating in pretrial proceedings and trial of
the above-referenced matter before this Court.
