RAMDEEN, et al., % Sos f j Defendants. % : / REPORT AND RECOMMENDATION OF THE MAGI: Issues Presented: Case Management Conference. THIS CAUSE has come on to be heard before Magistrate Antonio Perez-Benitoa on December 9, 2010, pursuant to the Notice of Case Management Conference. The Magistrate has jurisdiction pursuant to Florida Rules of Civil Procedure, 1.490, et seq. This Court being otherwise advised, the following Findings of Fact and Conclusions of Law are made: FINDINGS OF FACT AND CONCLUSIONS OF LAW 1. On July 23, 2009, the Plaintiff, BAC Home Loans Servicing, LP, FSB, filed a Foreclosure Complaint against the Defendant, Karen L. Ramdeen and any and all unknown parties including Glades Golf & Country Club, Inc. 2. On August 5, 2009, the Defendant, Glades Golf & Country Club, Inc., filed its Answer and Affirmative Defenses. 3. Defendant, Glades Golf & Country Club, Inc., filed its Notice for Trial on September 20, 2010. 4, A Case Management Conference was scheduled for December 9, 2010. ThePlaintiff and Defendant, Glades Golf & Country Club, Inc. participated in the Case Management Conference, but the other parties to this cause did not. RECOMMENDED ORDER OF THE GENERAL MAGISTRATE Based upon the above-stated Findings of Fact and Conclusions of Law, the Magistrate submits the following Recommended Order for approval of the Court: 1. Plaintiff, BAC Home Loans Servicing, LP, has thirty-five (35) days from the date the Order Adopting Recommended Order is signed to notice for hearing its Motion for Summary Judgment. 2. If Plaintiff fails to comply with this Court’s Order, the Defendant, Glades Golf & Country Club, Inc., may write to the judge requesting that this cause be scheduled for trial on the Court’s next available trial docket. 3. The parties shall have ten (10) days in which to submit exceptions to this Report of the General Magistrate. DONE AND ORDERED in Chambers in Collier County, Florida, this /6 day of LQ OC, 2010.
