COMES NOW Yefim Koza and EFN Investments, LLC (hereinafter “Defendants”), by and

through the undersigned counsel, and file this Motion requesting the Court to compel the Plaintiff to

provide dates on which they are available to take the video deposition of Defendants’ medical expert,
Dr. Jeffrey S. Penner, M.D., and in support states as follows:

1. This is an auto negligence action filed by the Plaintiff stemming from a motor vehicle

collision involving the Defendants, which occurred in April of 2014. Plaintiff is seeking
approximately $900.00 in damages for repairs to the vehicle and approximately $67,000.00 in relation

to medical expenses.

2. This matter is currently set to jury trial on April 2, 2019. Four (4) days has been

reserved for trial. See attached Exhibit “A

3. On February 25, 2019, almost immediately after our office received the trial order1,
our office contacted Dr. Penner to confirm that he would be available for the trial period.

4. On or about February 26, 2019, our office was notified that Dr. Penner would not be
available for the trial period.
5. On that same day, Defendants’ counsel notified Plaintiffs counsel of the availability
issue and asked to schedule a video deposition of Dr. Penner for March 18,2019. Defendants’ counsel
was advised that Mr. Freddy Rhoads, Esq. was unavailable for that date. Co-counsel for the Plaintiff
Maria Abellon, Esq.’s office did not respond with their availability for a deposition.

6. In response, Defendants provided yet another date (April 1, 2019) for a video
deposition of Dr. Penner. On February 26, 2019, Defendants’ counsel was advised that Mr. Rhoads

was not available for a deposition on that date either. Again, Mrs. Abellon’s office did not respond
with their availability for the April 1, 2019 deposition.

7. On March 1, 2019, Defendants’ counsel spoke with Plaintiffs counsel as a good faith

attempt to confer on the pending issues of this case, including dates for a video deposition of Dr.

Penner.

8. On March 4, 2019, the undersigned counsel followed up with the Plaintiffs counsel
regarding the scheduling of a video deposition of Dr. Penner via email.

9. To date, we have not received any possible dates for a video deposition of Dr. Penner,

despite the fact that two different law firms represent the Plaintiff in this matter.
10. Despite the Defendants’ good faith efforts to ensure Dr. Penner is available for trial,

and attempts to schedule a video deposition more than 30 days from date that trial begins, Defendants

have been unable to obtain possible dates that counsel would be available to take a video deposition.
11. Based on this exigent circumstance, Defendants respectfully request an order
compelling the Plaintiff to provide at least 3 dates on or before the April 2, 2019, on which their
office(s) are available for a video deposition of Dr. Penner.
12. Defendants certify that this motion has been brought in good faith and not for the
purpose of delay.

WHEREFORE Defendants respectfully seek an Order compelling the Plaintiff’s counsels to
