On August 1, 2023, the Court considered Plaintiff Esther Obregon, Trustee of the Maria
Davila Trust’s Motion for Summary Judgment (“Motion”). After considering the pleadings on file,
including all responses and replies, all evidence submitted to the Court, and the arguments of
counsel, the Court finds that the Motion should be and is hereby GRANTED.
IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that Plaintiff’s Motion
for Summary Judgment is GRANTED.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that the Court renders
judgment in favor of Plaintiff for full fee simple title in and possession of Lots 7 and 8, Block 55,
City of Hidalgo, Hidalgo County, Texas, as per the map or plat thereof recorded in the office of
the County Clerk of Hidalgo County, Texas, the property that is the subject of this suit, and have a
writ of possession for same.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Defendant Jesus
Davila, Jr. and any and all persons claiming an interest in the real property at issue in this matter
take nothing and they have no ownership in the above-described property.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that all costs relating to the
claims of Plaintiff are assessed against the party incurring same.
