ORDER SETTING NON JURY TRIAL
THIS Court hereby directs the parties (and attorneys for each of the parties if a party is
represented by counsel) to appear before this court for Non-Jury Trial as directed below at the
Broward County Central Courthouse, 201 SE 6” Street, West Tower, Courtroom 13154, Fort
Lauderdale, Florida 33301:
TRIAL DATE: MONDAY, February 22, 2019 beginning at 9:30 a.m.
DISCOVERY: must be completed no later than 10 days prior to the date of the Trial date.
TRIAL SUMMARY/CATALOG: must be filed by each party (and served on the opposing
party), no later than 5 days prior to the Trial date. Failure to timely comply may result in the
dismissal of the claim, final judgment or striking of witness and exhibits.
The Trial Summary shall contain the following separately numbered paragraphs:
1. Exhibit List: exhibits shall be listed by number and description; a copy of the exhibit must
be provide to the opposing party (do not file exhibits in the court file);
Note: an extra copy of all exhibits must be brought to court on the day of Trial.
2. Witnesses List: witnesses names, including “expert, mu, rebuttal” or “impeachment”
witnesses, and addresses shall be listed numerically. With respect to “expert” witnesses,
the nature of his/her expertise, and a brief statement of the opinion that will or may be
offered shall be attached to the stipulation, together with copies of any reports created by
the “experts”;
3. All witnesses must be present for Trial. The Court will not permit witnesses to appear via
telephone.

FAILURE TO FILE A TRIAL SUMMARY/CATELOG, including witness lists, exhibit lists, may
result in a postponement of the trial, and/or sanctions, including but not limited to, dismissal
and/or default.
At trial, the parties shall be strictly limited to witnesses and exhibits disclosed. A party desiring
to use an exhibit or witness not previously disclosed must immediately, upon discovery, notify
all other counsel and the Court. Use of the exhibit or witnesses may only be allowed for good
cause shown or to prevent manifest injustice.
ALL MOTIONS, including Motions for Summary Judgment, must be heard no later than ten
(10) days before the Trial date.
NO CONTINUANCES OR EXTENSIONS WILL BE GRANTED WITHOUT PRIOR WRITTEN
MOTION AND ORDER. REQUIREMENTS OF THIS ORDER CANNOT BE WAIVED BY
STIPULATION.
FAILURE TO ATTEND THE TRIAL WILL RESULT IN DISMISSAL OR DEFAULT.
SIMULTANEOUSLY HEREWITH, the parties are being referred to mandatory mediation,
which shall be completed within 60 days of the date of this Order.
