13 Steven Palermo, and I represent a woman named Melinda
14 Ankum with respect to an incident that occurred on
15 December, December 18 of 2020.
16 This I'm to be you
morning going asking
17 some questions with respect to that incident. If at

9 A I own it.
10 Q And how long htve you owned it?
11 A Roughly 30 years.
12 Q And that, that company is incorporated?
13 A I'm sorry?
14 Q It's incorporated; correct?
15 A Yes.
16 Q And what's your position at the
17 corporation? Are you an executive officer or

19 A I'm the president.

21 And what type of business is Lawn

23 A It's a commercial maintenance and
24 construction company, landscape construction.

12 A 20.
13 Q And back in December of 2020, how many
14 employees?
15 A Same, 20.
16 Q Does it vary by season?
17 A Minimally.
18 Q And as the president, what are your
19 daily job responsibilities?
20 A Oversee operations, deal with vendors,
21 deal with Fairfield managers, handle

4 staff.
5 Q Does that mean you had shared duties?
6 Is what you mean by that?
7 A Implied. I have a contract.
8 Okay. What -- when you in

10 responsible for as Lawn Raiders?
11 A Well, we would be responsible for
12 plowing the roads, the sidewalks, road
clearing
13 salting, road sanding, and ice melt to the
applying
14 sidewalks.
15 But a Fairfield representative, either
16 the supervisor or one of his minions, would typically
17 go out before we would be dispatched and start plowing
18 the roadways. Contractually, we don't go out until
19 there's a minimum of two inches of snow on the ground.

4 A There's head-in parking. It's not a
5 specific parking lot. It's head-in parking off the
6 roadway.
7 Q And you would do both of those things

9 A No, we wouldn't do parking spaces, no,

6 A Impossible.
7 Q Well, I mean, doesn't seem like it would
8 be impossible; just seems like it was something you
9 wouldn't do?

15 company, but a person in general could've have
16 shoveled snow between cars; correct?

8 snow from in between cars, whether it be somebody from
9 your company or any other company?
10 A I've seen residents cleaning their cars,

12 Q Had you ever seen anybody from Fairfield
13 Village at Coram cleaning in between cars?
14 A I don't recall, no.
