I represent Diane Knight.
Suppose that the ad misidentified the property. Would that not
be a good cause to stop the sale?
Diane Knight has an absolute right to ask that the ad be
corrected to contain the standard language when buildings and
improvements exist thereon. She did not waive her right to
recover surplus money that will be available. The stipulation
did not include a deed in lieu of foreclosure.
It is now patently clear that Diane Knight’s suspicion about the
fact that there is something fishy going on with the sale is
correct. Why are plaintiff’s attorneys so inexplicably obstinate
and reluctant to add a few words to the ad.
I ask this equitable Court to stay the foreclosure sale
scheduled for August 8, 2023 and to allow the insurance check be
used to repair the property for sale.
