AGREED SCHEDULING ORDER
This order applies to parties appearing pro se as well as those represented by counsel.
The following deadline dates shall apply to this case unless modified by the Court.
Compliance with this Scheduling Order will not substitute for any supplementation required by
the Texas Rules of Civil Procedure.
l. 6/3/24 TRIAL IS SET FOR THIS WEEK.
2. 3/4/24 Deadline to Amend Pleadings. All pleadings asserting new
claims or defenses must be filed by this date. Amended
pleadings responsive to timely filed pleadings under this
schedule may be filed after the deadline for amended pleadings
if filed within two (2) weeks after the pleading to which they
respond.
3. 5/3/24 Discovery Deadline. A11 discovery must be completed by this
date. Parties may initiate discovery beyond this deadline by
agreement. Incomplete discovery will not delay the trial date.
4. 1/8/24 Plaintiff‘s Expert Witness Designation Deadline. \All
information regarding testifying expert witnesses set forth in
Rule 194.2(f), Texas Rules of Civil Procedure must be served
on all parties.
As to retained experts only, Plaintiff shall furnish a written
report of such expert, setting forth the substance of the expert’s
findings, observations, opinions, and other expected testimony.
Plaintiffs must file and serve affidavits concerning cost and
necessity by the assigned date in accordance with Chapter
18.001 of Texas Civil Practice & Remedies Code.

5. 2/8/24 Defendants' Expert Witness Designation Deadline. All
information regarding testifying expert witnesses set forth in
Rule 194.2(f), Texas Rules of Civil Procedure must be served
on all parties.
As to retained experts only, Defendant shall furnish a Written
report of such expert, setting forth the substance of the expert’s
findings, observations, opinions, and other expected testimony.
Defendants must file and serve the counter-affidavits by the
assigned date in accordance with Chapter 18.001 of Texas Civil
Practice & Remedies Code
6. 5/03/2024 Dispositive motions: Any Daubert or Robinson challenges to
expert testimony and Motions for Summary Judgment must be
filed and heard by- the Court.
7. 5/3/2024 Mediation to be conducted by this date.
Agreed mediator ofparties is Mike Carnahan.
8. 5/20/2024 Parties shall file and exchange a witness list, designation of
videotaped deposition testimony that will be offered in direct
examination and a list of exhibits, motions in limine and/or jury
instructions and shall exchange copies of any proposed exhibits
not previously produced in discovery. Except for records to be
offered by way of business records affidavits, each exhibit must
be identified separately and not by category or group
designation.
ALL 0F THE DEADLINES SET
OUT ABOVE, EXCEPT THE DAY 0F THE TRIAL, MAY BE
CHANGED BY WRITTEN AGREEMENT 0F ALL PARTIES AND WITHOUT FURTHER ACTION BY THE
COURT.
UNLESS COVERED BY THIS ORDER, ALL OTHER MATTERS SHALL BE GOVERNED
ACCORDING To THE TEXAS RULES 0F CIVIL PROCEDURE.
THE PARTIES ARE SEVERALLY RESPONSIBLE FOR PROVIDING A COPY OF TIIIS
SCHEDULING ORDER TO ALL PARTIES JOINED AND/OR ATTORNEYS MAKING AN APPEARANCE
AFTER THE DATE THIS ORDER IS SIGNED.
AGREEMENT TO THIS SCHEDULING ORDER DOES NOT PRECLUDE ANY OF THE PARTIES OR
COUNSEL FROM SEEKING A MOTION FOR CONTINUANCE IN THIS MATTER.
