INTRODUCTION l. C itibank bro ught this claim against Defendant for the collection ofa debt arising from charges andfor cash advances made by Defendant using a credit card furnished by the Plaintiff. Plaintiff is seeking amounts due for unpaid charges, accumulated interest, fees and attorney fees. 2. South Dakota law relating to interest rates is important t0 this case because pursuant Bank Act, a national bank may charge its customers interest at the rate allowed by t0 the National the state where the bank is located. Plaintiff is a national bank located in Sioux Falls, South Dakota. 3. Plaintiff asks the Court to take judicial notice of South Dakota law concerning interest rates and additional laws governing credit cards and revolving charge accounts found at 54-3—14, 54-3-1 6, South Dakota Codified Laws Sections 54-3-1.1, 54-3-2, 54-3-4, 54—3-5, 54-3-13, 54-1 -1, 54-1 1-5, 54-] 1-6.1, 54-1 1-6.2, 54-] 1-6.3, 54-1 1-9, 54-11-10, and 54-1 1-1 1. Said Sections 1 are attached hereto and marked as Exhibit A. In addition, Plaintiffreserves the right to supplement i \ any and a1! 0fthese Sections. Plaintiff incorporates herein the Claim and supporting documents 0n file in this claim as well as the authorities cited therein, as support for this Motion and the necessary information for the Court t0 take judicial notice of South Dakota law and other foreign law. B. ARGUMENTS AND AUTHORITIES 4. Citibank is a national bank located in Sioux Falls, South Dakota. Citibank is organized under federal law (the National Bank Act at Title 12 0fthe United States Code) and is regulated by the Office Ofthe Comptroller 0fthe Currency in Washington, D.C. National banks are instrumentalities ofthe federal government and, as such, are protected from state regulation (except 0f the t0 the extent permitted by the United States Congress) by virtue 0f the Supremacy Clause United States Constitution as interpreted judicially by the rules compromising the preemption doctrine. Marquette National Baflk QfMinneapoh's v. First omeaha Services, (1978) 99 S. Ct. 540, 545. this case S. South Dakota laws relating to interest rates are important and relevant t0 because part of Plaintiff” s claim is for the recovery 0f interest charges incurred with the subject credit card. Citibank has charged interest for the subject credit card account at the legal rates allowed by federal laws and the laws of the state 0f South Dakota. 6. Section 30 of the National Bank Act of 1864, Rev. Stat. § 5197, as amended, 12 loan customers “interest at the rate allowed U.S.C. § 85, provides that a national bank may charge its by the laws 0f the State...where the bank is located.” Smifey v. Citibank (South Dakota), NA, 517 U.S. 735, 737 (1996); See Patten v. Maryland Bank, NA, 126 S.W. 3d 532, 533 (Tex.App.- Houston [1 5‘ Dist] 2003, n0 pet.) citing Marquette Nat. Bank ofMinneapofis v. First omeaha Sew. Corp, 439 U.S. 299, 308, 99 S. Ct. 540, 545 (1978). The National Bank Act of 1 864 preempts state law. Patten, 126 S.W.3d at 534; Smiiey v. Citibank (South Dakota), NA, 517 U.S. 735, 744, 116 when determining Whether the interest and fees charged by S. Ct. 1730, 1735 (19.96). Therefore, where Citibank were appropriate, the Court must consider the law 0f South Dakota, is Plaintiff located. in a credit 7. Additional provisions 0f South Dakota law regarding contract formation Plaintiff seeks recovery for breach 0f card agreement are also important and relevant t0 this case as Plaintiff has established the formation of a contract between itself and the Defendant contract. pursuant t0 the terms 0f South Dakota law. 8. On the motion ofthe party, a Court must take judicial notice ofthe constitutions, public statutes, rules, regulations, ordinances, court decisions, and common law ofevery other state, territory orjurisdiction Ofthe United States, Tex.R.Evid. 202. 9. If a party makes a written request that a court takejudicial notice 0f foreign state law and supplies the court with sufficient information, the court must take judicial notice 0f the law. Tex.R.Evid. 202; see Daugherty v. Southern RT. Ca, 772 S.W.2d 81, 33 (Tex. 1989). Plaintiff incorporates herein the Motions on file in this claim as well as the authorities cited therein, as support for this Motion and the necessary information for the Court t0 takejudicial notice 0f South Dakota law. C. CONCLUSION 10. Plaintiff is located in the state 0f South Dakota and is a National Bank. Because Citibank is a National Bank, it is governed by the National Bank Act which provides that a national bank may charge its customers interest at the rate allowed by the laws 0f the State . . . where the bank is located. Additionally, the Terms and Conditions governing the Agreement between Plaintiffand Defendant includes a choice 0f law provision stating that South Dakota law governs the agreement. Citibank is located in the state 0f South Dakota.
